BREAKING NEWS: Los Angeles Housing Department "Director of Compliance & Code Enforcement" (OVER REAP) -- LEAVING THE DEPARTMENT AND LEAVING THE CITY!

LA CITY NEWS EXCLUSIVE - BREAKING NEWS (Not yet released to the public.)

For the past month, you have been reading on this blog about the conflict of interest and corruption allegation within the Los Angeles Housing Department (LAHD). Of specific interest was the RENT ESCROW ACCOUNT PROGRAM (REAP). AND, what SEEMS to be the FACT, that once you are placed on REAP rent reduction program, you allegedly do not get your money back from the city and are not removed from the rent reduction program.

The conflict of interest allegations were discussed at a July 21, 2010 Los Angeles City Council meeting and the allegations were followed up over the past month by Zuma Dogg; after being sent a detailed memo from within the LAHD by workers who were scared to speak out about the corruption because upper management at LAHD is "vicious" as it was stated to ZD.

So between hardcore corruption allegations at LAHD, as described in the memo as being at the hands of Roberto Aldape which is hurting BOTH property owners AND tenants -- ALONG with the turmoil that has all but shut down the department in a hostile and "vicious" environment --

ZUMA DOGG felt moved to come off a long hiatus to NIP this activity (though no longer just a bud) -- and waves WERE felt within the department.

Vendors victorious in dust-up over Venice Beach rules

10.27.10 LOS ANGELES — A federal judge has struck down city regulations governing who gets to sing and sell along crowded Venice Beach in Los Angeles.

U.S. District Judge Dean Pragerson ruled last week that the city's weekly lottery system for distributing permits to boardwalk vendors and performers during the summer season violates the First Amendment.

Pragerson issued a temporary injunction, saying the city should issue permits on a first-come-first-served basis.

The judge also struck down a rule barring amplified sound and musical instruments between 9 a.m. and sunset in certain areas.

The city's 2008 ordinance, which was revised last year, was contested by 13 performers.
Plaintiff and street performer "Zuma Dogg" told the Los Angeles Times yesterday that the city should have changed the ordinance to address performers’ concerns.

"You have to pay a permit fee for free speech, and that's wrong," he was quoted by the newspaper as saying..

PUBLIC NOTICE Regarding Venice Beach Ocean Front (Boardwalk) for All Performers, Speakers & Artists [No More Paid Permits or Lottery and Amplifiers Allowed In ANY Space Along Boardwalk]

On October 21, 2010, a Federal Judge ruled in favor of 12 Venice Beach performers who filed for an injunction against the City of Los Angeles regarding Ordinance 42.15.

The ordinance required performers, speakers and artists to pay a permit fee; then appear for a Tuesday morning lottery for a space to set up in, each and every week.

So if you wanted to express your U.S. Constitutionally protected FREE SPEECH; first you had to PAY for a PERMIT, then throw your name in the hat (lottery) for the CHANCE to be able to speak on Saturday or Sunday. Seemed fishy.

Especially when LAPD decided to start writing tickets to performers for having a mic stand displayed that was over 4 feet. (After selling a permit to set up to perform in the space which allowed for amplification.) SO WHAT SPEAKER OR PERFORMER IS 4 feet, or under, besides Verne Troyer, who rarely appears to speak?

Additionally, the city reduced the amount of spaces that performers may set up with amplifiers to one little area in front of Sidewalk Cafe. So all the musicians had to fight for spaces, there -- and wait HOURS for a short set. NOW, speakers and musicians may set up all along the boardwalk, so everyone doesn't have to fight/compete/share one small area along the entire boardwalk.

Some may not be happy about some or all of this. So you must consider, the FEDERAL JUDGE waited YEARS for the City of Los Angeles to put together a reasonable ordinance that was NOT in violation of the U.S Constitution's First Amendment. The city could have EASILY put something together that would have prevented their DEFEAT in Federal Court, placing an injunction on their illegal law. They simply went way overboard and reach way too far, as they always do, and City Hall leaves judges NO CHOICE!

SUMMARY: As of October 21, 2010, artists, vendors, speakers and performers no longer need to pay for a permit (no more permits, at all); no longer need to appear for the Tuesday morning lottery (no more lottery, at all), and may amplify your message or performance in any space along the boardwalk. (However, you still need to be aware of possible "disturbing the peace" violations if you think you are playing "Staples Center."

And while you were being Mr. Political, campaigning all over town -- defending your "high-five" -- YOU HAD YOUR EYE OFF THE BALL AND ZUMA DOGG BEAT YOUR OFFICE IN FEDERAL COURT AND NO MATTER WHAT YOU DO -- OR WHAT YOU TRY -- YOU ARE GONNA BE DIPPIN' INTO THE RESERVE FUND FOR SEVERAL MILLION DOLLARS.

I will remind people, that I contacted Carmen after I walked out of the Federal hearing to tell him what a flimsy, lousy, joke of a job his attorneys did in the court room. Remember I was saying how (until this week's ruling) it was, "the best day of my life." I warned the city attorney's office they needed to settle "cheap" and get ZD and Dowd out of the gadfly business.

BUT, NUCH was arrogant and I will mention on TV, that while the city has NO PROBLEM settling lawsuits amongst their rich and powerful crony developers, the city just couldn't bring itself to settling a CLEARLY LOSING POSITION ON THEIR PART (which now we see it was) -- simply refuses to pay Michael Hunt, Matt Dowd, Zuma Dogg and the others cause were poor, not part of their inner circle, and are too embarrassed (as they SHOULD be) that they LOST to guys like us.

AND NOW, BECAUSE OF THAT...IT WILL COST SEVERAL MILLION DOLLARS: Here's why...

There are twelve plaintiffs on the lawsuit. ZD, Dowd & 10 others. We are each going to be getting our own MOST EXPENSIVE AS POSSIBLE ATTORNEY (which isn't hard to do when you have a FEDERAL COURT ORDERED INJUNCTION RULED, not in NUCH's favor...BUT IN ZUMA DOGG'S FAVOR!

So, 12 expensive attorney's with hourly fees (with this complicated and certain to be LONG, on-going jury trial for damages)...can EASILY rack up to SEVERAL MILLION DOLLARS in NO TIME. A Federal Judge ruled on October 21, 2010, which placed an injunction on the City of Los Angeles' ban of amplified sound on the boardwalk. And you no longer need to register with the city and pay money for a permit to express your 1st Amendment Free Speech. PLUS, the lottery has been thrown out, where anyone who wanted a space on the boardwalk, had to show up on Tuesday morning and enter a lottery. Of course the city sold UNLIMITED number of permits, for a VERY LIMITED amount of space. (Especially for performers who want to amplify sound.)

TRUE, this does set the city back years and years...WORSE than square one. Because can you imagine the insanity that will now ensue, once everyone finds out you don't need a permit, don't have to show up for a lottery and are allowed to set up your amps, anywhere you want along the Venice Beach boardwalk.

Editor's Note: On Friday, the City Council will once again consider approval of the Community Redevelopment Agency's plan to sell the property at 1601 N. Vine St. tn Hollywood to Hal Katersky's Pacifica Ventures for $4.65 million less than it paid him for it four years ago. The deal has sparked such heated controversy that the Council has repeatedly delayed action. In this open letter, to the Council attorney and community activist Richard MacNaughton http://www.blogger.com/post-create.g?blogID=5567642553940370181reports that a critical document showing the property was worth far less than the CRA paid for it in 2006 and calls for a criminal investigation.

EXCERPTS:

The CRA/LA and CD 13 Councilman Eric Garcetti have concealed from this council, the May 23, 2006 Pacific Real Estate Consultants' appraisal which the CRA/LA had obtained on May 23, 2006, showing an appraisal value of only $4,070,000.00, which is $1.38 M less than the Ellis Appraisal.

Presumably, all councilmembers, except CD 13 Councilman Eric Garcetti, relied on the material representation that there was only one appraisal and it was for $5,450,000.00.

Presumably, no councilmembers, other than CD 13' Councilman Eric Garcetti, would have voted to pay $5.4 M for a piece of property which the CRA/LA's own appraisal said was worth only $4.0 M.

As councilmembers know, there had been serious questions about the propriety of the sale/purchase and the appraisal for the Ullman "Capitol Records" parking lot. Thus, it appears that CRA/LA and CD 13 Councilman Eric Garcetti falsely represented to the Council in 2006 who was the real seller of 1601 N. Vine to CRA/LA.
