FBI Questions Payment Made By Los Angeles City Councilman JOSE HUIZAR

BEYOND ROOF REPAIRS?: The FBI said it would not confirm or deny the existence of any investigation. But two ex-Huizar staffers, speaking on condition of anonymity because they feared retaliation, said they also discussed the councilman in separate interviews with federal agents.

The former Huizar aides said they were asked if they knew anything about Huizar's bank accounts. Both said they did not.

Challenger Rudy Martinez says FBI asked him about Los Angeles Councilman Jose Huizar

Rudy Martinez says federal agents questioned him about payment for repairs to a rental house owned by Jose Huizar. A spokesman for Huizar denies that any investigation into the Los Angeles councilman is underway.

The acrimonious race between Los Angeles City Councilman Jose Huizar and onetime friend Rudy Martinez took an unusual turn Monday when the challenger said federal agents had questioned him about some of Huizar's private business dealings.

Martinez said FBI agents interviewed him roughly six months ago about various issues, including repairs that he arranged for Huizar in 2006 and 2007 at a rental house owned by the councilman and his wife.

Martinez, 44, said two agents met with him for two hours last summer in Glendale and asked about work he had coordinated at a Spanish-style house owned by the councilman in El Sereno. The work cost $10,330 and included painting, new carpet and plaster repairs, said Martinez, who has a real estate business in addition to a sushi restaurant in Eagle Rock.

Martinez said Huizar had not paid for the work at that time. Instead, Martinez wound up paying the various contractors. Then, just over a week ago and in the heat of the campaign, Martinez received a check for $8,980 from Huizar's wife, Richelle Rios.

A spokesman for Huizar strongly denied that any federal investigation was underway involving the councilman and said the check from Huizar's wife arrived only recently because the amount due had been in dispute. Parke Skelton, a Huizar political consultant, said Martinez is "stirring up as much trouble for Jose as he possibly can" because his campaign is in trouble.

"No one is investigating Jose," he said.

The issue of home repairs has come up before in Huizar's Eastside district. In 1999, former Councilman Richard Alatorre resigned after federal prosecutors conducted an investigation into roof repairs at his Eagle Rock home. He pleaded guilty to felony tax evasion two years later for failing to report more than $40,000 in income.

Martinez said two FBI agents met with him in July and asked how he knew Huizar. Martinez said he told them that he had refinanced Huizar's home in Boyle Heights in 2006 and, about the same time, helped supervise repairs at Huizar's rental house on La Calandria Way.

"They asked if he ever paid for that work," Martinez said. "I said no. They asked if I ever sent invoices, and I said yes, I did."

Some of the repairs at that home were needed so an employee of then-newly elected school board member Monica Garcia could move in, Martinez said. Garcia herself showed up at one point to see how the house looked, he added.

"Despite my continuing concerns, I remain committed to resolving this dispute," Huizar wrote.

SACRAMENTO – State Controller John Chiang today announced his auditors were beginning reviews of 18 redevelopment agencies (RDA) across the state in an effort to obtain facts on how RDA funds are used and the extent to which they comply with laws governing their activities.

“The heated debate over whether RDAs are the engines of local economic and job growth or are simply scams providing windfalls to political cronies at the expense of public services has largely been based on anecdotal evidence,” Chiang said. “As lawmakers deliberate the Governor’s proposal to close RDAs and divert those funds to local schools and public safety agencies, I believe it is important to provide factual, empirical information about how these agencies perform and what they bring to the communities they serve.”

The 18 RDAs selected for the reviews represent urban, suburban and rural communities. They are geographically diverse and represent a mix of varying populations. The reviews will look at, among other things, how the RDAs define a “blighted” area, whether they are appropriately paying for low- and moderate-income housing as required by law, whether they are accurately “passing through” payments to schools within their community, and how much RDA officials, board members and employees are being compensated for their services.

To assist lawmakers in their budget debates, the reviews will be completed in early March. The chosen RDAs are as follows:

Can Zuma Dogg Have City Council's $52 Million CRA Agenda Item Overturned Over Brown Act Violation?

I just thought of something. Matt Dowd and Zuma Dogg won a good portion of our 1st Amendment lawsuit vs The City of Los Angeles when a Federal Judge placed an injunction on much of the Venice Beach ordinance 42.15.

There is still a remaining portion of the lawsuit for the Honorable Judge Dean D. Pregerson to rule on, since he only issued an injunction at this point.

Much of the remainder of the lawsuit (I think ALL of it) centers around the "Code of Conduct" portion of the Dowd/Dogg 1st Amendment lawsuit that includes Venice Beach -- AND challenges the "Code of Conduct" for 1st Amendment violations while Dowd/Dogg were protesting the Venice ordinance at the council meeting.

And although DOWD/DOGG could be wrong, we expect the judge may find that although the "Code of Conduct" may host constitutional legal muster -- as they applied the code to Zuma Dogg and Matt Dowd, our 1st Amendment rights were violated ("as applied.")

(You just have to trust us, that most likely, the city will lose, "as applied," because Dowd/Dogg have the advantage of hearing the questions the judge was asking, and it didn't sound good for the city in a summary judgment.)

SO THIS BRINGS US TO THE $52 million CRA item for Eli Broad's parking lot to go along with his museum.

Zuma Dogg was giving public comment, and was cut off and ejected for calling Greig Smith a, "jackass clown."

Maybe disrespectful, but not in violation of any type of code in this country.

So when this goes to summary judgment, and if/when the city LOSES on "Code of Conduct," Zuma Dogg will immediately file for a Brown Act violations on all the item you screwed me on -- and they will have to be reconsidered. (And deadlines will probably have passed on the city's window of opportunity on the CRA money.)

PLUS, I AM GOING TO FILE A "BROWN ACT" VIOLATION IN SUPERIOR COURT FOR THE $52 MILLION CRA/BROAD ITEM OVER SMITH & GARCETTI. (DO NOT HAVE TO WAIT FOR SUMMARY JUDGMENT...CAN SIMPLY FILE A BROWN ACT COMPLAINT, ON ITS OWN.)

THE LONGER THE CITY WAITS, THE MORE STUFF I THINK OF...AND IT DOESN'T MAKE ME THINK I SHOULD BE LOWERING THE SETTLEMENT FIGURE, BUT RAISING IT.

PARTIAL ARGUMENT ON ZD'S BROWN ACT COMPLAINT ON $52 MILLION CRA/BROAD ITEM: While Mr. Dogg, who had the floor, was delivering public comment, Councilman Smith was shaking his head, "no" to Mr. Dogg (a form of "non-verbal" communication.) This caused a disruption to Mr. Dogg. Additionally, Mr. Smith made "funny, sourpuss" faces and was bouncing his shoulders around in an attempt to taunt, distract and disrupt Mr. Dogg.

Due to the position in the horseshoe in which Mr. Smith sits, in relation to the speaker's podium, Mr. Smith is within the view of speaker at all times, and any measure to try and avoid Mr. Smith's disruption (like closing your eyes) is not a reasonable measure a speaker should have to take during comments on complex and complicated items, while speaking on a two minute timer.

During the exchange, when Mr. Dogg commented on Mr. Smith's communication during his comment, Council President interrupted Mr. Dogg to warn, "control yourself and lower your volume."

"Control yourself" is too vague. Control what? Eye movements, hand gestures, nervous twitches, etc.? Not a narrow enough warning. And when Mr. Garcetti warned, "lower your volume," by what standard of measure. Certainly, other speakers rise to the level of volume Mr. Dogg, who go unwarned.

In response to the disruptions and distractions caused by the faces made by Mr. Smith; the loss of time at the end of the item; and for ejection from the meeting for merely saying, "jackass clown," which is protected under the 1st Amendment and is not in violation of the "Code of Conduct" as applied...

I think Garcetti shouldn't of risked a $52 million CRA item for Eli over the words, "jackass clown."

And now we will see what a judge has to say. This can be filed at the Superior level, or Zuma Dogg has Federal standing on this, as well.

AND...since I had a lot of time over the weekend, since I am still a gadfly; and since LAPD is still making ZD cranky on their selective enforcement -- THE NEXT VENICE BEACH LAWSUIT IS NOW READY TO BE FILED. VIDEO: Zuma Dogg Entrapped by Jose Huizar Staffer in CLARTSgate TURKEY SCANDAL!!! -- LA City News "Week In Review" for 1/30/11

OH NO! Zuma Dogg was turned into an un-witting criminal by accepting stolen property, when a Jose Huizar staffer presented Zuma Dogg with a 'Jose Huizar CD 14 CLARTS FUND" turkey for Thanksgiving 2008! I PLEAD ENTRAPMENT!!! These turkey have been allegedly paid for by CLARTS fund money -- and certainly not meant to spend on turkeys for Zuma Dogg. Luckily, I sold it to someone on the street for a quick five dollars and I avoided salmonella poisoning, cause the CLARTS FUND TURKEY was already WAY TOO DEFROSTED, Y'ALL!

(But that is bullsh*t, cause this IS a newly posted blog post and contains the newly typed paragraph, above. We'll call it, "The Garcetti" argument.)

L.A. CONTROLLER WENDY GREUEL: Wendy's mom, who passed away a couple years ago, owned Frontier Supply. (Like a Home Depot building supply store.) Since Wendy's mom passed away, I understand Wendy and her brother now own it, and I heard their relationship quickly went south. When Wendy was Councilmember, I was told that if you got the supplies from Frontier Supply for your project (gave Frontier Supply the business for your City of L.A. project) -- allegedly, you would have facilitated project approval. I was told to sit in front of Frontier Supply and watch the trucks that pull into the lot to pick up supplies and compare it to the list of developers who had projects approved.

ANTONIO VILLARAGIOSA & JOSE HUIZAR (Both as CD 14 Councilmembers): Look into the Wyvenwood Project in CD 14 (Boyle Hts area). Campaign money out of Florida that Villaragiosa took from a local TV station owner, had to be given back.

But more money was allegedly given (in a suitcase, perhaps). It is alleged that Huizar took a trip to the Superbowl, one Sunday, to pick up a suitcase of money to help cronies win elections. (I think HIS!) I questioned Huizar about the trip to Florida for Superbowl Sunday...and he was HELL BENT on proving to me that there was no possible way he could have been there. (Even though his story had holes in it.) WHY WAS HE TRYING SO HARD TO CONVINCE ME, ZUMA DOGG, A GADFLY that he did not go to the superbowl --- and spend so much time trying to defend a time line. (He sounded like O.J. Simpson.) But there are HARDCORE allegations of corruption on this project. SCARY STUFF...SCARY PEOPLE!!!

I really don't think Garcetti should have kicked me out for the entire meeting today. And Summary Judgment isn't enough. Money for Zuma Dogg isn't enough...I AM GOING FOR HANDCUFFS...

Remember Zuma Dogg announced today on TV 35, during the Los Angeles City Council meeting that he was contacted by some folks who had an appointment with the FBI for some "public comment?" Well, I heard that public comment input lasted for about an hour and a half.

And those folks don't know one one millionth of what Zuma Dogg knows, on other stuff. So I figured if I type up a report with links to some nice blog posts...maybe the FBI will end up dragging someone out of council chambers in handcuffs.

I warned you about LAHD and the REAP (Rent Escrow) and it ended with H. Mortezaie (the guy in charge of REAP enforcement) HIGH-TAILED IT OUT OF THE DEPARTMENT -- AND I HAVE HEARD FROM MULTIPLE SOURCES that the FBI is asking questions (inquiry or investigation) into LAHD's REAP program. (Mercedes Marquez, Roberto Aldape, Hakha Mortezaie. WHAT ABOUT YOU, ERIC? Would any trails lead to YOU on this stuff? Maybe we're about to find out?)

So now it is time to move on to the next item up for bid on the City Council's Price is Right:

LAANE: It ties into affordable housing, non-profits and the CRA. A FINE topic to enlighten the FBI to.

Zuma Dogg Quoted In L.A. Times on $52 Million for Eli Broad Museum & Parking Lot (CRA Project)

L.A. City Council agrees to speed up spending $52 million in redevelopment money before governor can tap it

The Los Angeles City Council voted Wednesday to spend up to $52 million in redevelopment funds on public improvements around a downtown museum, hours before Mayor Antonio Villaraigosa was set to meet with Gov. Jerry Brown to discuss ways of shielding redevelopment agencies from elimination.
On a 12-0 vote, the council endorsed a decision, made last week by Villaraigosa's appointees on the redevelopment board, to earmark the money for new sidewalks, a public plaza and a 370-space parking garage next to the museum, which is planned by billionaire Eli Broad, affectionately, referred to as "The Broadfather."

That museum, which would go up on Grand Avenue just south of Walt Disney Hall, has a scheduled opening of 2013 and could break ground within weeks.
Critics complain that redevelopment agencies siphon much-needed property tax revenue away from other services, such as schools, public safety and county hospitals. Brown has proposed the elimination of redevelopment agencies as part of his effort to close a $25.4 billion budget hole.
Villaraigosa and many other California mayors are trying to persuade state officials to come up with an alternative plan. Regardless of the outcome of those talks, Brown’s plan would not prevent the redevelopment agency from completing the improvements on Grand Avenue.
Under an agreement reached last summer with the Broad Collection, the nonprofit group that will build and operate the museum, the city earmarked up to $30 million for public improvements. Wednesday’s vote adds another $22 million.
The mayor’s redevelopment commissioners approved the new agreement last week, even though it was still being drafted. At the time, three board members complained that it had been sent to them hastily and one, Madeline Janis, voted against it.
Although redevelopment proposals are normally vetted by a council committee that focuses on economic development, Councilman Herb Wesson agreed to send the proposal immediately to the council for a vote.
 “Zuma Dogg," who ran for mayor in 2009, told the council that he opposed the deal, arguing that redevelopment money should be used to reduce blight. He questioned whether Grand Avenue, which features the Music Center and other cultural facilities, qualifies. [FYI: It's not whether it SHOULD go to blight...it may only go to blight.]



Redevelopment officials countered that the city would ultimately own the parking garage and the other improvements, including widened sidewalks and a nearby 35,000-square-foot plaza. They said the museum and associated projects would create 1,463 jobs, all but 100 of them in construction.
“We have to embrace good redevelopment when we see it,” Council President Eric Garcetti added. [IT'S NOT ABOUT "GOOD REDEVELOPMENT," BRO...It's about "BLIGHT." A PRETTY PLAIN AND NARROW DEFINITION. And, "good" doesn't apply.]

Deborah Kanter, general counsel for the Broad Collection, said her organization supported construction of the plaza, saying it would be a “great public amenity” that would link Grand Avenue to a planned subway station. She said museum planners originally assumed that the work would not be completed for up to a decade. [NOT FOR GREAT PUBLIC AMENITIES...FOR BLIGHT!]

Kanter said the new, more aggressive construction timeline is part of a larger effort by the redevelopment agency to speed up work that was originally envisioned as part of the nearby Grand Avenue project, which included a planned Frank Gehry-designed skyscraper. That project stalled after its financing fell apart. [So the project you planned for years stalled...so you are just deciding to rush through something else. WHO CARES WHAT PEOPLE WANT? WHO CARES WHAT THE COMMUNITY NEEDS? It's a good project so jam it through for Eli since the other thing was scrapped. After all, we can get the money...so we better come up with a reason to use it. WHAT'S THAT...BLIGHT? Oh, who cares!?!?!]

“We are not the drivers here,” she said.
Now that the work has been accelerated, Broad will spend up to $6 million to add benches, plants, signage, trash cans and paving to the proposed plaza. “That’s what Mr. Broad is doing as a good citizen, because he believes in the museum project,” she said.

Walter E. White and James C. Griffin brought this action against the City of Norwalk, California, and certain of its officials, under 42 U.S.C. Sec. 1983. White and Griffin are citizens of Norwalk who were ruled out of order when they spoke or attempted to speak at City Council meetings. In district court, they sought: (1) a declaration of unconstitutionality and injunction against enforcement of Norwalk Municipal Code Sec. 2-1.2, which prescribes rules for persons addressing the City Council; and (2) damages against the City and its officials for preventing plaintiffs from speaking, in violation of their rights of free speech and equal protection of the laws. The district court denied declaratory and injunctive relief, and a jury rejected the damages claim. We affirm both decisions.

I. Factual Background

The events that precipitated this litigation took place at three meetings of the Norwalk City Council between 1979 and 1982. At the first meeting, on October 9, 1979, plaintiff White was recognized to speak during a discussion concerning a contract for the City's annual calendar. White contends that while he was speaking, a council member interrupted him and incorrectly claimed that there was a motion on the floor and that White would accordingly have to stop speaking. White states that when he attempted to continue, the mayor had him escorted from the room by a deputy sheriff. The defendants contend that White was ruled out of order for being unduly repetitive and was escorted to his seat for refusing to stop talking after the Major ruled him out of order and asked him to desist.

The second meeting in question took place in either January, February or March of 1980. Plaintiff Griffin claims that he was speaking on an agenda item when he was interrupted by a council member who declared him out of order and had him escorted out of the Council chambers. Griffin did not recall the topic he was addressing nor what he said, but he testified that he made no personal attacks and did not yell, curse or use foul language. The defendants contend that there was simply no evidence sufficient to establish what occurred, and suggest that Griffin was probably ruled out of order for being repetitive.

The third meeting occurred on January 25, 1982. White alleged that he was speaking about a legal matter involving a city official. He claimed that he was told that the subject was a personal matter and that he should submit his information in writing. He alleged that when he attempted to take a written statement out of his pocket to distribute to the Council, he was immediately ruled out of order and removed from the room.1

White and Griffin brought this action in October 1982, seeking to have the Norwalk City Ordinance governing appearances before the City Council declared unconstitutional and enjoined, and also seeking damages for interference with their first and fourteenth amendment rights on the three occasions discussed above. Both claims having been denied, they appeal.

[As they should be denied. Nothing but hearsay, without knowing what the subject was -- or what you said; or when you said it; and no evidence of proof.]

II. Challenge to the Ordinance

In order to understand this case, it is essential to know that there is surprisingly little relationship between plaintiffs' claim for declaratory and injunctive relief and their claim for damages. Plaintiffs attack the ordinance purely as being unconstitutional on its face, for overbreadth and vagueness. They have laid no foundation for attacking it "as applied." The provisions of the ordinance that they challenge played no part in the jury trial concerning their three abortive appearances before the City Council, and the jury was not instructed on the ordinance.2 Indeed, the record indicates that the ordinance was adopted in January 1980, after the first meeting in dispute had occurred.

Plaintiffs are consequently compelled to show that the ordinance is void on its face, if they are to succeed. The ordinance provides, in pertinent part:2-1.1(b) Rules of Decorum. While any meeting of the City Council is in session, the following rules of order and decorum shall be observed:

3. Persons Addressing the Council ... Each person who addresses the Council shall not make personal, impertinent, slanderous or profane remarks to any member of the Council, staff or general public. Any person who makes such remarks, or who utters loud, threatening, personal or abusive language, or engages in any other disorderly conduct which disrupts, disturbs or otherwise impedes the orderly conduct of any Council meeting shall, at the discretion of the presiding officer or a majority of the Council, be barred from further audience before the Council during that meeting....

[At minimum, Mr. Dogg will argue how even if this is found to be legally compliant, his damages are for "as applied." However, Mr. Dogg will also be arguing how he was in no time in violation of (3.). And calling Mr. Smith a "historic jackass clown" was in context and relation to his performance as Councilman and based on the history of comments Mr. Smith has directed at Mr. Dogg. And the fact that Mr. Dogg was cut off before finishing the sentence, prevented Mr. Dogg from framing it in context as described above and as it related to the item.

A "personal remark" would be something like, "Greig Smith is a bad father. Or, "Greig Smith is a terrible bowler." "Greig Smith is ugly...etc." "A Historic Jackass Clown" relates to his performance as CM and based on the history of comments by Mr. Smith, directed to Mr. Dogg, in an attempt to call Mr. Smith the opposite of, "Prophetic Scholar."]

2-1.1(d) Enforcement of Decorum. The rules of decorum set forth above shall be enforced in the following manner:

1. Warning. The presiding officer shall request that a person who is breaching the rules of decorum be orderly and silent. If, after receiving a warning from the presiding officer, a person persists in disturbing the meeting, the presiding officer shall order him to leave the Council meeting. If such person does not remove himself, the presiding officer may order any law enforcement officer who is on duty at the meeting as sergeant-at-arms of the Council to remove that person from the Council chambers....

[Mr. Dogg was ejected from 1/26/11 for "insults" -- not disruption. And he was ejected for the "insult" without a warning. And was not allowed to remain and speak on other items as John Walsh had just been allowed to, after Mr. Walsh created a sustained and prolonged outrageous screaming disruption.]

3. Resisting Removal. Any person who resists removal by the sergeant-at-arms shall be charged with a violation of this Section.

4. Penalty. Any person who violates any provision of this Section shall, pursuant to Section 1.08.010 of the Code, be guilty of a misdemeanor.

Plaintiffs focus particularly on the proscription against "personal, impertinent, slanderous or profane remarks." They argue that such imprecise and content-oriented terms render the ordinance fatally vague and overbroad, under well-recognized first amendment doctrine. See, e.g., Gooding v. Wilson, 405 U.S. 518, 92 S.Ct. 1103, 31 L.Ed.2d 408 (1972) (criminal statute punishing utterance to another of "opprobrious words of abusive language" is void for overbreadth); Lewis v. City of New Orleans, 415 U.S. 130, 94 S.Ct. 970, 39 L.Ed.2d 214 (1974).

The City, however, offers a construction of the ordinance that is far narrower than that of plaintiffs. The City asserts that, properly construed, the ordinance does not permit discipline, removal or punishment of a person who merely utters a "personal, impertinent, slanderous or profane" remark. That provision is qualified, the City states, by the next sentence of the ordinance, which authorizes removal of any person:

who makes such remarks, or who utters loud, threatening, personal or abusive language, or engages in any other disorderly conduct which disrupts, disturbs or otherwise impedes the orderly conduct of the Council meeting....

Norwalk Mun.Code Sec. 2-1.1(b)(3) (emphasis added). Thus, the City asserts that removal can only be ordered when someone making a proscribed remark is acting in a way that actually disturbs or impedes the meeting. The same threshold is required, according to the City's reading of the ordinance, for warning and removal under section 2-1.1(d)(1) and for prosecution under section 2-1.1(d)(4).

[Mr. Dogg contends that the mere utterance of "jackass loser" or any "coarse" language does not constitute a disruption, just because a councilmember will pop up out of their seat like a Pop-Tart out of an over toaster and storm out the door in outrage.]

Walsh said, "Tricky-Ricky Garcetti," and, "Alarcon is 'playing with himself'..."

Yet, Garcetti allowed him to remain seated for the rest of the meeting where he was allowed to continue to speak on other items. Even though, Garcetti considered his comments to be, "sexual" in nature -- and Mr. Walsh refused to quiet down, after NUMEROUS warnings.

Zuma Dogg said, "...Greig Smith, jackass clown."

Garcetti immediately interrupted Zuma Dogg for making personal insults. (SORRY...we'll see what the judge has to say about the use of the term, "a historic jackass clown," especially as contrasted with Garcetti's application of "Code of Conduct" by comparison, just moments before.)

Garcetti can claim ZD was warned about personal insults...but not at this meeting...and how am I supposed to know what is illegal to Garcetti's ears? I though, "Jackass Clown," was a legal and censored way of saying, Fucking Asshole." So I think his definition may be too vague. Because I think any judge would remind Mr. Garcetti, that 1st Amendment -- AND THE CODE OF CONDUCT states that elected officials must endure coarse speech. And I'm sure any judge would say, "Jackass Clown" is not a violation of Code of Conduct, as applied -- and is not a violation of 1st Amendment, by any applied standard. GOOD LUCK, Mr. Defendant!

(FOR THE RECORD: Earlier during this public comment, Mr. Garcetti warned Mr. Dogg to "control yourself and lower your voice." That seems, "vague" -- control yourself? By what standard and measure. And they continue to have no standard to enforce for speaking volumes, while a speaker has the floor. BUT, Mr. Garcetti ejected me from the meeting, entirely, for "insults" -- when the previous warning was to, "control yourself." (VAGUE and nothing to do with the words, "Jackass Clown." That could have been whispered and still would have been considered an insult, since I wasn't ejected over volume.)

It should also be noted, that Mr. Dogg had a card in on the LA Housing Department Rent Escrow (REAP) item on the agenda. Mr. Dogg had already notified council of an FBI investigation or inquiry -- as Dogg was contacted by community members telling him they were meeting with the FBI.

Perhaps, Mr. Garcetti didn't care if Mr. Walsh remained for the rest of comments, because they were not going to be related to the REAP item -- and Mr. Walsh did not have the first hand information regarding the FBI inquiry (or investigation) -- and Mr. Garcetti most likely was using the"jackass clown" comment as a thin excuse to make sure Mr. Dogg did not have a chance to speak on the REAP item -- by ejecting him from the entire meeting, rather than issuing a warning -- and then simply taking the remainder of time my for the rest of my item, as he did with Mr. Walsh.

Seems like the "Code of Conduct" as applied today on Zuma Dogg may present some legal challenges for the City in Summary Judgment and in 9th Circuit (if necessary).

Donna Pearman addressed Mr. Garcetti very directly, speaking directly to him, with no warning from Garcetti or City Attorney about addressing council as a whole. The previous speaker, Theresa (from Boyle Heights) addressed Councilman Jose Huizar directly and spoke directly to him, with no warning from Mr. Garcetti or City Attorney.

And Zuma Dogg now announces that Los Angeles City Council President Eric Garcetti will be named, personally, in a lawsuit to be filed by Mr. Dogg, for today's 1st Amendment violations as alleged by Mr. Dogg.

The presiding City Attorney, Dion O'Connell, questioned Mr. Garcetti's process in the total ejection of Mr. Dogg, shortly afterward.

Yesterday (1/25/11), Mr. Dogg announced that settlement talks were over -- and a date of February 28, 2011 is available and has been tentatively penciled in for the date of the Summary Judgment hearing, pending Mr. Dowd's submittable of the motion by this Monday. (And he is typing as we speak.)

Previously, Mr. Dogg has stated that he now wants to take it all the way for a complete ruling by the judge, because most of what is yet to be ruled on is the "Code of Conduct" portion of the lawsuit. (Most of the Venice Beach portion had an injunction placed on it -- and there is little for the judge to rule on, there. BUT THE CODE OF CONDUCT HAS NOT BEEN ADDRESSED...AND IT IS STILL AN ISSUE, TO THIS DAY...)

I want this to be decided upon for the rest of time. It's an important 1st Amendment issue. And in these times of constituent outrage, when Council is and will be cracking down, more and more, ZD wants the judge to lay down the law -- so this stuff will not happen to others in the future.

SO I AM VERY FIRM ON GOING ALL THE WAY FOR A TOTAL RULING...

HOWEVER, there ARE other people involved -- and I have to be SOMEWHAT practical -- so I had an offer of $400,000 that I would have to be willing to accept -- to prevent moving to summary judgment.

AND I DON'T CARE IF THE CITY ATTORNEY OR CITY COUNCIL THINKS THAT IS TOO MUCH...THEN FINE...SUMMARY JUDGMENT...(You have a problem now, cause I WANT to go to summary judgment.)

But after today's incident at City Hall, the figure has been amended to $500,000. (The amount I would have to prudently accept on behalf of others who factor in to this decision and I would have to live with the defeat of not having "Code of Conduct" ruled by the judge.)

So again...EVEN if the City Attorney settles with ALL THE OTHER 11 plaintiffs to avoid summary judgment...because that's what this is all about...THE CITY WANTS TO AVOID SUMMARY JUDGMENT AT ALL COST..AND ZD WAS IN A HURRY TO GET PAID...BUT UNFORTUNATELY, NOW HE'S SO PISSED OFF -- AND TIME IS UP -- AND IT IS NO LONGER ABOUT FINANCIAL REASONING AT THIS POINT!

You forgot to evaluate who and the type of person you are dealing with. I walked away from a Times Square Radio & Record career because Billboard tried to "triple my work -- at the same pay." I said, "No." When they insisted, I got pissed...and QUIT!

THEN...they BEGGED ME TO STAY -- AND THEN they offered the money I asked for in the first place. BUT TOO BAD...I MOVED TO L.A.

So my only recourse is to file a NEW lawsuit, focused ENTIRELY on "Code of Conduct" where I will not only argue in full, the problems with it -- that were not brought out and exposed and detailed by the losers in Norwalk who filed a suit against, "Code of Conduct." AND THEN...there is the even EASIER to slam-dunk, "as applied" on Zuma Dogg. (They violated their own Code of Conduct with my ejections for the reasons they ejected me for, "as applied" to the Code of Conduct.)

SO GARCETTI NAMED, PERSONALLY, AS A DEFENDANT ON THIS ONE! (When you compare his enforcemtn of John Walsh, compared to Zuma Dogg...the city is lucky I didn't up it to $1.2 MILLION...I WANT SUMMARY JUDGMENT...MATT DOWD NOW KNOWS -- YOU CANNOT TALK ME OUT OF THIS...except if I am forced to accept defeat by accepting $500,000 for the physical pain and suffering I was forced to endure while sleeping in a small car, and then the cement sidewalk, due to the economic and emotional duress, suffered.
