L.A. Council Retaliates Against FEDERAL Ruling By Cutting Public's Time in Half

In 2012, L.A. gadfly Zuma Dogg won a Federal ruling by Federal Judge Dean Pregerson, pertaining to Los Angeles City Council's rules for public, during public comment -- and enforcement of their rules. The judge ruled that L.A. City Council was in violation of U.S. & State law in what was called, "censorship of the public," by the judge. (And quoted Plato to describe ZD's efforts, as a gadfly.)

In response to the ruling (since the ruling); members of the public have been able to speak, in the spirit of the Constitution; and council may not apply their own (fake) laws, that violate REAL FEDERAL & STATE laws. So, they can't just cut people off and kick them out, if they don't like what is being said, under whatever guises they were claiming.

L.A. Council retaliated; by cutting general public comment time in half. (From 2 minutes to 1 minute.)

One minute is not a reasonable amount of time, for a typical, non-professional speaker (general member of the public) to be able to articulate a complex issue -- and provide comment on how to solve the problem/what is being asked for of council. It's a form of censorship. General public comment time, at other local government meetings (Board of Supervisors/MTA/LAUSD/DWP/Santa Monica City Council) are two or three minutes; and no general public comment time is limited to one minute.)

Additionally, it must be considered that people must take off the day; pay whatever transportation costs to get to City Hall; wait through presentations; and wait through endless runs around the horseshoe, where councilmembers try to out campaign each other, with long winded speeches, that repeat what the other previous councilmembers have already said.

General Public comment is at the end of the presentations and meeting (the public has to wait two or three hours); and council claims they are only willing to give members of the public one minute, at a public meeting, for members of the public to address issues before council -- because they are short on time. A form of censorship.

L.A. Council gives people two minutes to speak on agenda items (what COUNCIL wants to talk about), but only one minute for general comment (what YOU wanna talk about.) If council grants two minutes for agenda items, why would it be different to address other important issues of the city, not on the agenda, that day? Some issues people choose to address, occur in a timely, breaking news timeline; before it makes it to the agenda, if it ever does, at all.  If you can speak for two minutes about someone's star installation on "Hollywood Walk of Fame," why not two minutes to address city homeless crisis; or LAFD response times; or a solution for the city to be able to keep streets clear of trash and garbage; since they currently are not. Who can explain the pros and cons of the economic effects of the city's push for $15 minimum wage in a minute? 

To make someone endure an entire trip to city hall; wait through presentations and an entire meeting; to have to try and cram their issue into one minute; is more than a member of the public should have to endure. Not because two minutes is that much more than one minute in the scheme of things; but because one minute is truly not enough time to satisfactorily address most issues before a body of elected officials. Which makes the entire effort a waste of time and council's form of censorship.

I hope to present these details to Judge Pregerson. I wonder how he would feel about council retaliating against his ruling by cutting public comment time in half? Kinda combative/hostile move.

The point IS...you are not required to show ID to enter the city hall for the council meeting...and you are NOT required to be an attorney to state the name of the law.

On February 17, 2012, entered L.A. City Hall and the police officer, behind the visitor desk, asked for my ID. 

I said, "No, not today, thank you."

The officer asked me where I was going. I said the council meeting. 


She insisted for the ID again. I again replied that I did not want to show ID to attend the meeting. 


She called another supervising officer to the desk, who again, asked me where I was going, then asked for ID.  [I got nervous when the one cop called over the second cop. Was I in trouble? Imagine how anyone else would fee?]

I again, had to explain I did not want to show ID. Then he required me to utter the words, "Brown Act," before the other officer would hand me the pass. 

The point is that no ID is required to attend the council meeting. Not that the person, showing up to give public comment or observe the meeting, has to be a legal expert and know the names of the laws. The laws are merely to be followed. 

This was more than anyone should be expected to reasonably endure to be admitted to the council meeting. The request alone has a chilling effect. 

February 21, 2012, I once again entered Los Angeles City Hall, went through the metal check, the walked to the lobby desk for a "visitor" pass, to attend the L.A. City council meeting. 

The officer (a different officer) said, "Let me guess, no ID." I said, "right." She explained, "That's fine." (As in cutting a break/no biggie/slack was being given). Then added, but, the Brown Act applies to the council meeting. This is the lobby. We don't share information. And you are not required to show ID to enter the meeting.

When I said, "That means you have to show ID to enter the meeting," there was some more back and forth. HERE IS THE ENTIRE AUDIO OF THE CONVERSATION:

City Hall strategy appears to be, "We DON'T require ID to attend the meeting. But, due to security issues, everyone must show ID (and the police write the name and address down on paper, as in a record book). And then, they may attend the meeting without showing ID. And since the City Hall lobby doesn't share the information with Council, it's allowed.

However, not requiring ID to attend the meeting, means you don't need to have an ID. BUT, if you need an ID to enter City Hall, that means you cannot enter the council meeting.

Additionally, the process has a chilling effect on anyone who would walk up to City Hall, see a line of people showing ID to the police, or if no line, getting to the lobby desk and having a police officer ask you for ID. 

The City will argue that it is required for security, but if someone breaks the law in city hall, then a cop will detain the person -- AND THAT IS THE POINT IN WHICH YOU ASK FOR ID! 

The officer told me, it was annouced in "roll call," that they WERE going to start REQUIRING ID, with no "Brown Act" proclamations in the lobby, because Brown Act does not apply to the lobby. 

This already has a chilling effect on Zuma Dogg, cause I don't wanna wake up early, leave my beach area, to head all the way to Skid Row adjacent, through gridlock traffic, only to find out, TODAY, is the day the city starts enforcing that ID is required. CAUSE I AIN'T GIVING CITY HALL THE INFO (LIKE MY ADDRESS) -- TO ATTEND THE COUNCIL MEETING!

BOTTOM LINE: There is no way to attend the L.A. City Council meeting without showing identification, FIRST. 

City Hall has a red VISITOR pass (different than the blue VISITOR pass), to distinguish between those going to the council meeting, who did not show ID (and are restricted to the council or committee meeting/cannot go to other floors, or departments). So, WHY do you need to show ID at the door?

ADDITIONALLY, until this month, they have been asking for people's name and address on the public comment cards, without disclosing the information is NOT required -- and that they are public documents, posted online. 

How long is statue of limitations for this violation? Posting addresses online, without saying, "not required," is just about the most outrageous violation I can think of. A lot of BAD people, out there, who can access the info!

CITY HAS...IS I CONTINUE TO BE PREVENTED FROM THOSE ACTIVITIES, BECAUSE THE CITY CONTINUES TO ALLOW THE SAME ILLEGAL VIOLATORS TO RETURN, DAY AFTER DAY TO CONTINUE DOING THE THINGS, I HAVE BEEN BLOGGING AND SPENDING HOURS ON THE PHONE WITH LAPD/BILL ROSENDAHL, DISCUSSING. BUT TODAY, IT WAS WORSE THAN EVER! AND I HAD A THREE PERSON PRO-FILM CREW, STANDING-BY! (2 OF WHOM WERE FLOWN IN FROM CHICAGO!)

SO LET'S GET THIS STRAIGHT! Have LAPD Captian call me. I will sit in the car, with the cops, and drive em around and point out what to do, and they will do it, THEN, FIRST TIME! (Quality Management/EFFICIENT SYTLE!) And I am serious, and please make sure I get the call, TODAY, telling me what time, on Sunday. Cause if this shit isn't cleaned up by Sunday, YOU WILL NOT HAVE A MOMENT OF SILENCE DURING VACATIONS, IF IT SPILLS INTO NEXT WEEK! (Kinda like, "Summer School, for the DUNCES...but ZD's summer school ain't cancelled, unlike LAUSD's!) CALL NOW! OPERATORS STANDING BY. AND THIS IS NOT THE "PARODY" PART OF MY BLOG! As I walked away, I turned down a side alley, and RAN down Speedway, then went into a restaurant on Rose. (From Paloma starting point.) WHY WAS THE GUY IN THIS VIDEO WALKING UP ROSE, FROM THE BACK ALLEY ZD WAS JUST SEEN MOVIN' DOWN? Why was he lookin' back and forth, both ways, up and down the boardwalk, as I watched him from inside the restaurant through the window.

AND WHY IS HIS BOOTH STILL SET UP, WHEN I JUST WENT BACK THERE TO SHOW HOW HIS BOOTH WOULDN'T BE THERE, ANYMORE!

BUT, the cops told my friend (ALL ON CAMERA W/PRO CREW) that they didn't know exactly which guy I was talking about...EVEN THOUGH I GAVE SPECIFIC BOOTH LOCATION, OF WHICH THERE COULD HAVE BEEN, NO MISTAKE, UNLESS YOU ARE RAY CHARLES...BOTH BLIND, AND DEAD! DAMN!

AND THE PROBLEM IS, I said to LAPD cops, "Should I show you who he is?" And they said, "No, that may just incite it." HOW??? THE POLICE ARE THERE? ( I WASN'T GONNA WALK UP AND POINT MY FINGER IN HIS FACE...but could have gotten within half a block to poiint him out. PLUS, I had him on the video you didn't care to see.

But, then these cops say they don't know who I was talkin' about...SO HERE HE IS!!! TAKE THIS PICTURE WITH YOU, CAUSE I KNOW YOU WILL NEVER REMEMBER! There are SO MANY people, who look EXACTLY LIKE THIS, in that EXACT SPOT, EVERY DAY! (You'll NEVER be able to find him!)



And/But, if it isn't about thuggery, IT'S ABOUT A CLEARLY ILLEGAL DISPLAY! GET HIM ON THAT. CHECK HIM FOR A KNIFE, CAUSE HE WAS WILLING TO FOLLOW ME DOWN A BACK ALLEY TO PROTECT HIS "BUSINESS INTERESTS." (Which I am always told, "This is my business.") ONLY PROBLEM, it is NOT a business zone. It is a FREE SPEECH ZONE...and I couldn't find any spaces for any of that, today, AS U CAN SEE. And if you are CONSIDERING it your place of business, you will do ANYTHING to protect it, I guess. AND THAT IS THE PROBLEM!

PLEASE CALL IMMEDIATELY, TO LET ZD KNOW WHEN HE WILL BE RIDING ALONG WITH LAPD TO GET THIS SHIT DONE, ONCE AND FOR ALL..YOU ARE ALL SPINELESS, LAZY, COWARDS...AND I AIN'T LOSING MY FREE SPEECH OVER THIS ILLEGAL BULLSHIT...WHY ARE STILL READING, WHEN YOU SHOULD BE CALLING ME, NOW!
