Zuma Dogg versus The City of Los Angeles (Over Three and a Half Year Venice Beach Boardwalk Battle) City BETTING BIG, once again with losing hand

Looks like it's Dogg vs City of Los Angeles and this is nothing personal Nuch. (Click here for previous post on City Attorney's meeting with Dowd/Dogg/Venice Performers, where Zuma Dogg doesn't think the City Attorney knows enough for the city's own fiscal good on this matter.)

This is previous City Attorney Rocky Delgadildo's mess and hopefully NUCH will be able to come in for the save as relief pitcher for L.A. City and it's general fund.

The law is on the Venice PERFORMERS side. THE CITY BLEW IT, AS WITH DISPENSARIES, BILLBOARDS, PENSION MONEY AND EVERYTHING ELSE...AND WE ARE SIMPLY DRIVING A SUBWAY TO THE SEA THROUGH THE HOLES!

DELGADILLO AND CITY COUNCIL JUST SAT THERE FOR THREE AND A HALF YEARS AND MADE ONE MISTAKE AFTER ANOTHER AND WERE ARROGANT, AND COCKY, AND DUMB, AND DIDN'T LISTEN TO US, AND WE HAD TO SHOW UP FOR THREE AND A HALF YEARS, AND YOU VIOLATED THE FIRST AMENDMENT EVERY DAY OF THE YEAR AT VENICE AND AT CITY HALL...

AND I THINK ZUMA DOGG TOOK AS MANY MEASURES TO REMEDY THE SITUATION AS HE WAS HUMANLY ABLE TO, DAY AFTER DAY, AFTER DAY, UNTIL IT WAS OVER THREE YEARS...AND I HAD TO PUT YOU TO SHAME ON A DAY TO DAY BASIS IN HOPES OF THE CITY FINALLY "FIXING" THE FUCKING BOARDWALK -- AND YOU PAID CAROL SOBEL AND ACLU OVER THE SAME THING -- BUT YOU STIFFED HUNT/DOWD, and now you have fucked it up so bad, and made performer's lawsuits SO EASY...it would be irresponsible of me not to finally take care of this situation in court with a Federal Judge since it is becoming increasingly more dangerous and people have to be able to earn a living in that area that the United States Constitution allows them to. (Villaragiosa isn't President/Dictator of the United States, yet. And he's in no position to FUCK with the Federal Government's LAW based on his own municipal mafiosa-style thuggery.)

This FIRST AMENDMENT LAWSUIT, that is NOT about commercial vending, also includes BROWN ACT VIOLATIONS at the Los Angeles City Council meetings (NUMEROUS) along with the Venice Beach Performers violations. Matt Dowd is currently filing a move for injunction at Venice Beach which would put a hold on any regulations and allow and "anything goes" scenario on the boardwalk. And when the Judge sees how the city has handled this matter, and actually REMOVED performers spaces -- while at the same time selling unlimited amounts of permits to performers (racketeering), the injunction will be issued.

And with a Grand Jury investigating L.A. City Council (over what is to believed to be over "public comment," and District Attorney Steve Cooley having a "Brown Act" meeting as he casually mentioned on Kevin James radio show, last night...I THINK IT'S CLEAR ZUMA DOGG HAS HAD HIS FIRST AMENDMENT RIGHTS VIOLATED BY ANY COURT STANDARD. There are enough "no brainer," clear cut, outrageous violations to force the city to declare bankruptcy, to avoid the payments. (They've already racked up $470,000 on Hunt/Dowd...it's getting more expensive and there are 12 people on this lawsuit and if Dowd/Dogg win...EVERY OTHER PERFORMER WILL BE ABLE TO SUE...AND THAT'S WHEN THE CITY FALLS INTO SINK HOLE LIKE A FIRE TRUCK IN L.A. CITY AND HAS TO FILE FOR BANKRUPTCY PROTECTION. I know, I know...I'm always WAY out there on the doomsday stuff and how bad it will be...if only it didn't all come true. This is obvious and easy stuff...low hanging fruit. That's the magic of Dowd/Dogg. It's easy to do when you are the only two people with sight amongst a horseshoe full of the blind. (It's almost unfair of us.)

I'm going to ask Nuch to have Dowd/Dogg into his office to actually explain the real situation because, no offense to Nuch's attorney on the case, he's a nice guy, but after listening to him speak in a meeting, yesterday, it's clear he only has a surface level, insufficient amount of knowledge of the situation for the city's own good. NUCH, YOU ARE WALKING INTO A BUZZ SAW...you should have Dowd/Dogg explain it to you, and THEN you can make an informed decision. You ain't getting one from your side. And if you don't settle -- and take it to court...IT'S CLEAR...WE WIN...L.A. City LOSES...and then EVERY OTHER PERFORMER YOU HAVE EVER SOLD A PERMIT TO CAN SUE. (And Matt will be there to notify everyone and hand them the template...HELL, Matt will file the lawsuits FOR them.)

So sorry I'm cranky at times as a side effect of broken homelessness as too many people tell me how fantastic my efforts have been. I DON'T WANT TO HEAR THAT ANYMORE IF I AM DYING ON THE STREETS. I DON'T CARE THAT YOU ARE SITTING AT HOME ENJOYING ZUMA DOGG ON TV LIKE A SPORTING EVENT OR DAILY REALITY SHOW.

At the end of the day, the city can't afford to lose millions and millions and millions of dollars because they don't like our tone.

YOU JUST HAVE TO LIVE WITH IT AS YOU HAVE FOR THE PAST THREE AND A HALF YEARS AS WE CONTINUE TO PUMMEL YOUR ASS IN THE MEDIA AND COURT OF PUBLIC OPINION. NOW THE PEOPLE WHO HAVE BEEN RIGHT EVERY STEP OF THE WAY WILL PUMMEL L.A. CITY'S ASS IN A FEDERAL COURT ONCE AGAIN. And LA Times can run the headlines, "Venice Vagrants Beat L.A. City In Federal Court as City Pays Millions To Homeless Performers." Now THAT'S what Zuma Dogg calls, "spreading the wealth around."

Then I will buy Mary Cummins (Aka: Nutty Scummins) and make her read my blog 24 hours a day, seven days a week. Oh, I forgot, she already does that. LOL! Hey Mary...love your nutty comments. You have an audience of one, but a very satisfied audience. Too bad that's the only way you can satisfy anyone. KEEP 'EM COMING. And, "meow!"

Zuma Dogg Speaks On Neighborhood Council and DONE (Aka: Shady Rico Racket of a Waste of Time!)

Of course it's never going to work out between DONE and the community: Do you really think the mayor wants MORE input from the community. That's why all the conflict. You have people working for DONE who think it is supposed to be a useful community group, when the people in charge are there to throw a big wrench in the community. And it doesn't help when you have an interim GM who doesn't like to talk to people. He's not the type of personalble person you need in that position.

Keep wasting your time trying to fix the NC system...I'll see you in ten years and it will be the same discussions. Have fun running around in circles the way they want you to.

DO YOU REALLY THINK THESE CORRUPT, RACKETEERING COUNCILMEMBERS AND MAYOR WANT PEOPLE LIKE STAKEHOLDERS GETTING IN THE WAY OF THEIR PLANS?

You people sit at these NC meetings, not even realizing Antonio has stacked the deck with his own board members. And you don't even realize it. You should have seen the suckers at the Del Rey meeting who said that NC president is such a great guy. (Yeah, except he's running rough-shot over your meeting and rights. But he looks and sounds really good as he's shifting the money where HE wants to shift it.

And then the mayor has these non-profit groups sit up and beg for money like a puppy...and people think it hasn't already been established up front.

Villaraigosa Budget Update and Eric Garshady Squelches Neighborhood Council's Hope To Expand Input At Planning & Land Committe (See Crybaby Excuse)

Mayor's guests will see what goes into budget mix

This week, Mayor Antonio Villaraigosa invites opinion leaders and others to the annual economists briefing on what the city can expect this year.

It is all part of an effort by the mayor to step up public pressure on the City Council to rein in spending this year to try to reduce the impact of more potential cuts next year.

No surprises are expected from the economists - sales tax revenue continues to decline, the housing market remains in turmoil and the only bright spot is tourism.

But with the city projected to face a $155 million shortfall this year and another $300 million next year [Zuma Dogg has heard $600-$700 million according to one City Hall insider], Villaraigosa has proposed several cuts that have been stalled by the council.

"The longer the council waits, the more drastic the cuts will be next year," one budget adviser to the mayor said. "That's why he's pressing so hard this year."

A group of Neighborhood Council members began a drive last week to try to expand the City Council's Planning and Land Use Management Committee from three to five.

Lisa Sarkin, from the Studio City Neighborhood Council, issued a polite appeal to council President Eric Garcetti that said such a move would provide broader representation on the panel with greater input on planning decisions.

Garcetti aides said he would talk about it with council members but did not hold out much hope for change. [Because it would make it more difficult for Garcetti to slam his agenda through, un-opposed.]

The problem is expanding the panel would mean at least three members would have to be present to make decisions - and it is already difficult enough to get members to show up for committee hearings. [You have GOT to be kidding me? Don't you EVER call yourself a small "d" democrat, you "s" for "shady" councilmember.]

Arroyo Seco Journal Assistant Publisher Attacks the ER Neighborhood Council

Here is an article I wrote for the Arroyo Seco Journal earlier this year. It gives a general rundown of the disregard the fledgling ERNC had for TERA:

I recently attended the only Eagle Rock Neighborhood Council (ERNC) meeting I ever will attend. I went because I wanted to see for myself if everything I'd heard since the ERNC was first established in 2002 was true. It was. I’d heard about endless bickering and people quitting out of frustration on the spot. I’d heard of egos so into control that they were out of control. The meeting was a circus. I was told this meeting was mild compared to past ones.

It is well known that the initiation of the neighborhood council (NC) system was a way to dissuade parts of Los Angeles from seceding. This was the city’s way of "throwing a bone" to neighborhoods to convince them that they would suddenly have a certain amount of power where they didn't before. Now that the system is in place, if you could call it that, it seems the NCs don't really have the power they were promised. It was also to diffuse the power and influence that time-honored resident/homeowner groups had already acquired. Wrong move.

I was always very doubtful the NC concept applied to Eagle Rock because I believed it would work only in neighborhoods that really needed a voice. During the ERNC's formative months and for the 16 years previous to that, Eagle Rock already had a strong voice in the local residents’ association.

I served as the association’s president from 1997 to 2003 and left the board in late 2005. The ERNC president-to-be sat on the association’s board with me and knew how hard we worked. She then left the board in 2001 to throw her full effort behind the ERNC, which was perfectly understandable. I supported her since I knew her and she was a friend, but I never appeared at any ERNC formation meetings because, besides being skeptical about the entire idea, I didn't have the time.

I voted in the very first ERNC election. Because I have since witnessed various things that told me the ERNC really got off on and remained on the wrong foot, I never voted again. As soon as the new ERNC officers were installed, it seemed their first order of business was to believe the 1,000-strong residents’ association no longer mattered.

Our association’s established beautification committee was immediately and very publicly co-opted by the ERNC at an event that was disguised as one of good will. No one can disagree with beautification, so I guess the ERNC thought it would be a good first feather in their cap even though our association created the committee, managed the committee's finances, paid for its insurance, and footed the bill for advertising its events.

Just as suddenly, there was an ERNC land-use committee. It was odd since our association was created in 1986 because of land-use issues and was already taking care of such matters. The tenor of the committee’s first meeting was our group had “failed” and the ERNC was now there to save the day.

The ERNC also began its own e.letter, and it looked remarkably like the e.letter that we had published since 2000 and was very popular with readers. One can’t argue with success, and the ERNC version had a tone so similar to ours that I received e.mails suggesting we combine them. In a show of support, we posted the ERNC’s events in our e.letter, but they wouldn’t post ours until we specifically asked them to. These and other observations told me the ERNC tag line -- service, collaboration, participation -- was disingenuous.

For an NC to ignore an already strong, long-standing residents’ organization is a huge mistake. In Eagle Rock, true collaboration and partnership between the two groups could have created one very powerful voice. After all, both have the same goal of improving the community, but they have different mission statements and purposes, different resources, and different avenues to getting things done. Together, they could have really kicked some serious ass around here.

The ERNC’s initial missteps were a recipe for failure because the mission of community improvement was not the priority. Power was. For an NC to be truly productive, the egos must be left at the door.
