Zuma Dogg's Theory on Why His 2009 Blog Posts on PENSIONGATE Are Getting So Many Views TODAY!

PENSIONGATE UPDATE?: Over the past month, or so, I've notice my old blog posts on PensionGATE (Calpers, LACERS, Wetherly Capital, Elliot Broidy, etc.) has been getting a LOT of page views. These blog posts contain exclusive and detailed information, provided to me by high-level insiders who had direct involvement and knowledge of the players and events that transacted. So what do I attribute the elevated level of page hits on these blog posts?: GOTTA be some investigation going on regarding PensionGATE. Much of the New York stuff has been prosecuted by then AG Andrew Cuomo. And I have always maintained that any pension corruption tactics are tied to California and Los Angeles. The players BUSTED in New York were PEOPLE OUT OF L.A., like Elliot Broidy who plead guilty. And Dan Weinstein and Vicky Shiff of Wetherly Capital who took a deal with Cuomo that put them out of the pension business FOR LIFE. Keep in mind, when Antonio Villaraiogsa took office, the FIRST THING HE DID was appoint Elliot Broidy to the LACERS pension commission -- and appointed Wetherly Capital's longtime attorney as head of the CRA (William H. Jackson). So like Grand Funk Railroad, it's comin' to your town! (At least ZD sees some indications of such based on his blogger stats.)

Elliott Broidy Pleads Guilty to Felony Charge of Rewarding Official Misconduct Through Gifts of Nearly a Million Dollars For $250 Million Investment in Markstone

Gifts Included Payments to an Official’s Friends, a Sham Consulting Contract, Luxury Travel Expenses in Israel for Officials and Family Members, and a Concealed Payment to the Loglisci Brothers’ Movie, “Chooch”

NEW YORK, N.Y. (December 3, 2009) — Attorney General Andrew M. Cuomo today announced a felony guilty plea by Elliott Broidy, a founder and Chairman of Markstone Capital Group LLC, for his involvement in a pay-to-play kickback scheme at the Office of the New York State Comptroller (“OSC”).

Broidy acknowledged paying nearly one million dollars in gifts for the benefit of OSC officials to obtain a $250 million investment from the New York State Common Retirement Fund (“CRF”) in Markstone Capital Partners, L.P. (the “Markstone Fund”). Broidy pleaded guilty to a felony charge of rewarding official misconduct and will cooperate in the Attorney General’s ongoing investigation. Broidy will also forfeit $18 million in connection with his plea.

Today’s announcement arises from a two-year, ongoing investigation into corruption involving the OSC and the CRF. The charges to date allege a complex criminal scheme involving numerous individuals operating at the highest political and governmental levels under former Comptroller Alan Hevesi, in which the State pension fund was used as a piggy bank for the Comptroller’s chief political aide and a favor bank for political allies and other friends.

“Broidy paid nearly a million dollars in bribes to get a quarter billion dollar investment. For Broidy, this was a small price to pay. For New York taxpayers, the harm is incalculable,” said Attorney General Cuomo. “Corruption corrodes the integrity of the pension system and the public’s trust in government. That is too high a price to bear.”

Markstone is a private equity firm headquartered in Los Angeles, California with an office in Israel. The Markstone Fund focuses on corporate buyout investments in privately held companies in Israel.
Broidy resigned from his management role in Markstone on December 1, 2009. Broidy was also a trustee of the Los Angeles Fire and Police Pension fund from 2002 until he resigned in May 2009.

In his allocution to the Court, Broidy acknowledged making a series of payments to help induce and then increase the CRF’s investment in the Markstone Fund. The CRF ultimately committed $250 million to the Markstone Fund and paid over $18 million in management fees to Markstone. Broidy acknowledged that he had an agreement or understanding with certain high-ranking OSC officials: in exchange for certain benefits from Broidy, the OSC officials would exercise their judgment or discretion to benefit Markstone. Broidy acknowledged the following illicit arrangements:

● Broidy funneled $300,000 to “Chooch,” a movie produced by
brothers of David Loglisci, the Chief Investment Officer at OSC under Hevesi. To hide the payments, Broidy made them through a friend, with the understanding that Broidy would reimburse him, which Broidy did.

● Broidy entered into a sham consulting agreement with a family
member of a senior OSC official. Broidy paid more than $380,000 to the consultant over a period of more than two years.

● Broidy paid over $90,000 to the girlfriend of a high-ranking OSC
official from April 2004 through October 2005. [He looks like he would HAVE to pay for his girlfriends] The payments were used to cover the girlfriend’s living expenses and rent. Broidy also covered the girlfriend’s hospital bills. Broidy also agreed to pay $5,500 a month to a relative of the girlfriend beginning in October 2003, for a total of $44,000. These payments were concealed through a sham loan agreement between Broidy and the relative.

● In connection with the CRF’s investment in the Markstone Fund,
Broidy traveled to Israel with a very high-ranking OSC official on at least five occasions and on one occasion to Italy. Relatives of the OSC official were present on some of the trips. Broidy subsidized these trips, paying for accommodations and services for the OSC official, the relatives, and Loglisci. Broidy paid at least $75,000 for first class airfare, luxury hotel suites, a car and driver, a helicopter tour, and security detail on these trips. To conceal these payments, Broidy financed these expenses through charities and caused false invoices to be submitted to the OSC.

Broidy pleaded guilty before Justice Bart Stone in the State Supreme Court, New York County, Part 31, and was released on his own recognizance with travel restrictions. Broidy faces a possible sentence of up to 4 years in prison for the charge of rewarding official misconduct, a Class E felony.

Attorney General Cuomo’s investigation into corruption at the CRF has led to a number of criminal charges to date, including charges against Morris and Loglisci, former Liberal Party Chair Ray Harding, and investment advisor Saul Meyer. Meyer, Harding, hedge fund manager Barrett Wissman, and Julio Ramirez, an unlicensed placement agent, have pled guilty to Martin Act securities fraud charges for conduct related to the pension fund. Morris and Loglisci are presumed innocent until they are proven guilty in court.

Cuomo also issued subpoenas in May to over 100 investment firms and agents after his investigation found that 40 to 50 percent of agents obtaining investments from New York pension funds were unregistered.

Earlier this year, Cuomo announced his Public Pension Fund Reform Code of Conduct, which would eliminate pay to play in state public pension funds. To date, seven firms have signed onto the Code: The Carlyle Group, Riverstone Holdings, Pacific Corporate Group, HM Capital, Falconhead Capital, Levine Leichtman Capital Partners, and Access Capital Partners. These firms collectively have agreed to return nearly $60 million associated with New York State Common Retirement Fund investments; these funds will principally be provided to the CRF for the benefit of the pension holders.

In July, the United States Securities & Exchange Commission proposed new pay-to-play rules that would institutionalize Cuomo’s Code of Conduct nationwide.

Dec. 3 (Bloomberg) -- Elliot Broidy, founder of Markstone Capital Partners, pleaded guilty today in New York state court in Manhattan to “rewarding official misconduct” and will forfeit $18 million. Broidy was a target of New York Attorney General Andrew Cuomo’s probe of state pension fund corruption.

“I’ve entered a plea of guilty, sir,” Broidy told judge Lewis Bart Stone in New York State court in Manhattan today. “I made payments to high ranking officials at the New York State Comptroller.”

Broidy faces four years in prison and will cooperate with Cuomo’s probe. Cuomo said Broidy bribed four state pension fund officials, including former New York state chief investment officer David Loglisci. Stone set sentencing for June 10. Loglisci has been charged and has pleaded not guilty.

“This is a different scheme than we have discussed in the past,” Cuomo said on a teleconference call today. “This is an old-fashioned payoff-of-state-officials case. This is effectively bribery of state officials and not just one.”

Cuomo said Broidy paid nearly $1 million to get about $250 million from the state pension fund. Cuomo, who said the probe is still going on, declined to name the other state officials in addition to Loglisci he said were bribed by Broidy. Broidy resigned from Markstone today following his guilty plea, his lawyer Christopher Clark said.

Culture of Corruption

Broidy paid more than $90,000 for rent and living expenses as well as unspecified hospital bills for the girlfriend of a senior official in the Comptroller’s office, along with monthly payments totaling $44,000 to a relative of the girlfriend, Cuomo said. Broidy also paid about $75,000 for luxury travel to Israel and Italy for a senior official and his relatives, Cuomo said.

“So you can see the depth of the corruption in this case,” Cuomo said. He said there was a “culture of corruption” at the pension fund.

Broidy admitted to paying more than $130,000 between October 2003 and October 2005 to friends of the pension fund officials, who were overseen at the time by New York state Comptroller Alan Hevesi. Hevesi has not been charged.

Broidy in court earlier said he paid $75,000 for the trips to Israel and Italy. He said payments were concealed with the use of charitable organizations “and thereby caused false invoices to be submitted” to the Controller’s office.

Broidy gave $300,000 to help finance a movie called “Chooch,” linked to the Loglisci family, Cuomo said. To conceal his involvement, Broidy said, a third-party nominee wrote checks.

Broidy entered into a sham consulting agreement with a family member of a senior official in the Controller’s office. Broidy paid more than $380,000 to the consultant over a period of more than two years.

Fees

Broidy said that he won the right to invest $250 million in pension fund money, which generated $18 million of fees for his company. That’s the money he will forfeit.

Broidy has also been under investigation by the U.S. Securities and Exchange Commission.

The New York attorney general's pay-to-play investigation is focusing on a California venture capitalist who may have funneled money to people involved with the New York state pension fund while he was soliciting investments from the fund, according to people familiar with the matter.
Elliott Broidy, chairman of Markstone Capital Partners of Los Angeles and a prominent GOP fund-raiser, is being investigated for a $300,000 investment in a low-budget movie produced by a top executive at the New York state pension fund. The same day that Mr. Broidy made his initial investment in the movie, the pension fund approved a $200 million investment in one of his funds, the people said.

Elliott Broidy gave about $90,000 to actress Peggy Lipton, said people familiar with the probe.
The movie, called "Chooch," has been a focus of the attorney general's investigation. It was produced by David Loglisci, who was then head of private equity for the New York state fund, and his brothers. The pension fund later invested $50 million more with Markstone, for a total of $250 million, the people said.
Unlike other backers of the film embroiled in the probe, Mr. Broidy didn't invest the money directly but through an associate and under the associate's name, the people familiar with the matter said.
Mr. Broidy could face possible criminal charges from Attorney General Andrew Cuomo, including bribery, these people said. A spokesman for Mr. Broidy declined to comment. [THAT'S IMPOSSIBLE!!! WHO WOULD TAKE A BRIBE???]
Mr. Loglisci, who became the New York pension's chief investment officer, has been criminally charged in the case, as has Hank Morris, a political adviser to the fund's former trustee, Alan Hevesi. Messrs. Loglisci and Morris have denied wrongdoing and are fighting the charges, which include bribery and money laundering. Mr. Hevesi hasn't been accused of wrongdoing.
A lawyer for Mr. Loglisci declined to comment.
At the heart of the investigation is concern that the selection of managers to invest retirees' money was guided by influence peddling, rather than an eye toward the best results. Four people have pleaded guilty to criminal charges in connection with the investigation and are cooperating.
People familiar with the attorney general's investigation said it also is focusing on other possible actions by Mr. Broidy.
Between 2004 and 2005, they said, Mr. Broidy gave about $90,000 to actress Peggy Lipton to help pay for her Manhattan apartment and other expenses.

Ms. Lipton, also a model and singer and known for her role in the late 1960s television show "The Mod Squad," was romantically involved at the time with Jack Chartier, these people said.
Mr. Chartier was then chief of staff for Mr. Hevesi, the sole trustee of the pension fund.
Representatives of Mr. Chartier and Ms. Lipton didn't respond to requests for comment.
Additionally, the attorney general's office has been investigating whether Mr. Broidy loaned $44,000 to a relative of Ms. Lipton that a person familiar with the matter said was intended to help Ms. Lipton and wasn't meant to be paid back.
Mr. Broidy, 52 years old, is the former finance committee chairman for the Republican National Committee and a major donor to GOP candidates. His private-equity firm, Markstone, manages about $800 million and focuses on investments in Israeli companies.
He also is being questioned by the Securities and Exchange Commission for what the agency has called "possible violations" of federal securities laws as part of an investigation of allegations that investment firms made improper payments to secure pension fund business. The agency hasn't accused him of wrongdoing.
Mr. Broidy also served as a trustee of the Los Angeles Fire and Police Pensions fund. He resigned in May, saying that the SEC investigation was a distraction to the board.
He isn't the first person embroiled in the New York pension probe to invest in "Chooch."
Mr. Morris invested $100,000, and Barrett Wissman, a money manager and music impresario who has pleaded guilty to securities fraud in the case, contributed $150,000.
David Leuschen, co-founder of private-equity firm Riverstone Holdings, invested $100,000.
In June, Riverstone agreed to pay $30 million and eliminate the use of placement agents, or financial middlemen who earn fees by securing pension business for investment funds, in a settlement with the attorney general, which had been questioning the firm as part of the pay-to-play probe.
A Riverstone spokesman has said the firm and Mr. Leuschen continue to cooperate with the investigation.
Private-equity firm Quadrangle Group, which was co-founded by former Treasury official Steven Rattner, agreed to acquire the DVD distribution rights to "Chooch" through an affiliate called GT Brands that paid $88,841, according to the SEC's complaint in the case.
