A Message for Barack Obama, Eric Holder & Jerry Brown on California Pension Fraud (With BILLIONS LOST TO FRAUD, SOMEONE NEEDS TO BE HELD ACCOUNTABLE!)

A small circle of private equity firms and the politicians they back and get elected into office are responsible for billions and billions of pension dollars disappearing into thin air.
It was announced at an L.A. City Council meeting that the City of L.A. was invested in overly-risky, non-investment grade "alternative investments" (with emphasis on real estate). The result was a loss of -21% of the pension fund for the '08 & '09 period.

I believe the same illegal racketeering and fraud that Andrew Cuomo busted people for in New York, has also been applied, here in California.

I know you are friends and colleagues with a lot of the people responsible, but I hope you can bring yourself to see that at least some of these people are brought to justice, in hopes of shutting this pension-pilfer fraud ring down.

The City of L.A. sends out undercover sting operations to try and bust people selling a pack of one dollar incense at Venice Beach. They will write you a criminal ticket for standing in the wrong spot on the Venice Beach boardwalk:


MEANWHILE, these same people are responsible for billions and billions of taxpayers dollars being lost in a fraud and abuse scheme that Cuomo detailed in his investigation and I have posted on my blog.

I also heard you are trying to "shut down" the community redevelopment agencies (like CRA/LA) -- and this may be a tact you can use to do so. Pension money is being funneled into these projects in a cahoots-racketeering scheme. Shut down pension fraud, and you shut down the CRA.

CalPERS: Are THESE the Connect-The-Dot Memos Being Looked At In Pension Scandal Investigation?

Coming up, some more in the CalPERS pension scandal story that is unfolding here, thanks to some friends of Zuma Dogg. But to new readers (since there are about 200 times more than last month), here is why you should pay attention to Big ZD, from the 2-1-3. Read THIS K-Earth 101 - "Blast from the Past":

Those of you who know me from my political blogging elsewhere, know that I have immersed myself in politics this past couple years, and you hear a lot of things. (Deniro Voice: I heard things.) If you check my blogging, you will see that these contacts allowed my to blog about the subprime mortgage crisis on May 5, 2007 -- predicting a bubble burst that would trigger a year long recession starting in November of '07.

Well basically, it happened to the day of the prediction if you check the headlines. And in October, sources recommended pulling out of the stock market entirely (mutual funds and all), because the market was going to start sinking first thing January '08. And we all know what happened.

We also learned that this would cause a big problem in the credit derivatives and bond insurance market. This next shoe, ready to drop, is scheduled to drop in February of '08 (like, next week), when all these derivative options come due, and if you think we had some down 200-300 this past month...

Well, that was just the little wave warning you that the Tsunami is coming. And it ain't gonna be a one week -- or one month sell off. We have already seen things that haven't happened in 70 years, or so. Some things have NEVER happened. You see people who have traded for 20-50 years saying they have never seen a week like last week.

So Bush can try to keep things propped up by visiting the oil sheiks and asking for a break, fiscal stimulus packages, bond insurance bail out talk (even though there wasn't any real talk) -- and the Fed can cut half a point: BUT THEY WILL NOT BE ABLE TO KEEP THE MARKET ARTIFICIALLY PROPPED UP WHEN THE SUBPRIME AND DERIVATIVE MARKETS END UP BEING MUCH WORSE THAN ANYONE WAS LEADING ON TO.

When people start walking away from their homes (since they now owe more than they are worth, once those teaser subprime rates jump to market rate), banks will not only be stuck with all these homes -- they won't be able to sell them, either. (And they won't be taking in all this money, while the homes sink in value.)

People will be later and later on their credit card payments -- and many will simply walk away from those payments, too.

And when these derivative futures come due, it will be like what happened when everyone options were due last week, and everyone was caught short, and we saw a huge sell-off including all the good and profitable stocks to cover the losses on the others.

Bond insurers will be out of business, and we are already starting to see the leaks in the dam start to sprout water this past week.
Here's something I would like a news reporter to look into:

With the market down big this year, and bond insurers about to lose their AAA rating and will end up bankrupt in no time (more on that later) --

I wonder if any of this is having an effect on the City's LACER pension retirement fund. I know they like to play riskier investments than ZD would ever be taking for a pension fund.

Could be a real disaster. I have NO idea, I was just wondering as I thought about the bond insurer/subprime/etc mess, knowing how LACER invests.

But here's why I am blogging this post tonight:

Zuma Dogg has received a string of what I consider to be shocking memos regarding this whole CalPERS pension scandal. The content is shocking NO DOUBT...it's just a matter of how exclusive these memos are to Zuma's LA Daily Blog, or if the whole world has already seen them. (The reason I think this content WILL end up to be shocking, is because I do not think people would be sending them to me if they were no big deal.)

These are some pretty big fish swimming around in this story, so I don't wanna just go and post everything on a blog, which hits search engines, and then I find out the puddle was WAY deeper than I thought and it's too late to swim away.

So, here's a fun little excerpt to get the party started. (Or FEDERAL INVESTIGATION, hopefully, if this doesn't make you wanna party.)

Today Ms. Sticky has a new business partner who also has some strong real estate connections, i.e. California’s Coastal Commission and politicians to boot. Earlier this year Dan who is co-managing partner of Wetherly Capital along with Ms. Sticky was appointed

…as the alternate for David Potter… Wetherly Capital Group, which specializes in raising capital from public pension funds and jointly managed trusts. He [Beerstein] has served as a senior advisor for former State Treasurer Kathleen Brown and as a regional Political Director for the United Food and Commercial Workers.”

Dan Beerstein has a lot to be thankful for and no doubt credit is due elsewhere other than to luck. For starters there are the folks who buy and sell the produce we all eat as in Ron Shmurkle.

I know Dan Beerstein rather well and although he is connected I doubt he could “serf “ [sic] even as well as Mr. David Potter who I know nothing about but certainly he can blow lots of smoke. AND remember now we are talking about the California Coastal Commission not “sum poor hoarse” [sic] pension fund like “CALiPERS” [sic] where the folks are encouraged by powerful PACS to play pong in between trotting off to the banks to deposit their ill-gotten gains which then get recycled to make little mention of the leverage that will make the Modigliani Miller painting one of the few remaining "safe heavens" [sic]

MUCH more to come on this blog. I'm not sure how public this document is. And that's just the warm and fuzzy part I was comfortable posting before I check this out further. But I'm sure a lot of folks out there already KNOW about this. I just don't know if they have seen the actual memos from Gary Steve G., or not.

Villaraigosa's City Hall Must Implement Quality & Productivity Measures Under New Budget Crisis

You have heard me mention Dr. W. Edwards Deming and his 14 Point management plan to increase quality and productivity (how to do more with less and constantly improve through innovation and empowerment).

Well, with Los Angeles Mayor Antonio Villaraigosa banking on city workers to vote for their own pay reductions, or else face a wave a firings that will mean a cut back on services (having to do more with less) -- it is time to start from the beginning for anyone who wants to find out more about all of this 14 Point "myth" and what it really means.

Previously, I have posted links to "Interpreting Deming's 14 Points," the article that has been approved by Deming; published internationally in Quality Digest and praised by Fortune 500 executives. But now, since Zuma Dogg is always ahead of the curve, and after seeing what is about to happen in Los Angeles (massive layoff and loss of services) I wanted to post some of the notes from Deming's 4 day seminar to help give you a feel for the management philosophy.

As you read this material, I'm sure most of you will be able to apply it to your own personal and professional situations you encounter throughout the day, as well. The material is designed to unleash your creative, innovative spirit at the management level.

DEMING SEMINAR NOTES:

There is nothing worse than bad competition. Consumers attribute bad characteristics to all competitors of the industry. Also, bad habits are picked up by competitors that are not in the best interest of the industry, and everybody loses (customer and business).

The quality of your product and service (constituent/customer satisfaction) can be predicted by how happy and satisfied your employees/staff are.

Customers/Constituents judge quality/constituent satisfaction by their standards, not yours.

Have departments/staff work together at all stages of research, design, production and sales. Everyone must work in a cooperative, not competitive effort. (How many times have projects have to be sent back because one party wasn't talking with the other during the process?)

Q: What is the biggest producer of waste in American industry?
A: The present style of American management. Although these loses cannot be measured or evaluated, these are the losses that must be managed.

A change in direction is not a sign of a "wrong decision". A pilot makes frequent changes in course during flight based on traffic (competition) and weather (market conditions). A change in conditions requires a change in course.

Quality starts in the boardroom/chambers, for these are the councilmembers/media/leaders who possess the persuasive power to create change. It must start at the top.

Institute a vigorous program of education and self-improvement. Just as we reinvest in other resources, we must reinvest in a company's most important asset -- its people!

HERE'S A PREVIOUS BLOG POST ON THIS TOPIC:

Here's a summary of the same old pitfalls that are made time and time again; by industry after industry; and corporation after corporation. So no offense Mayor, you have the same problems Ford, GM, Proctor & Gamble or Japanese maufacturers post-WWII had. Deming is the cure. But I warn you: It challenges the status quo, requires massive transformation at the hands and mind of a true reforming leader and requires you to provide a work environment that creates worker pride and joy, instead of angry secret posts against their boss on Mayor Sam and through emails to ZD. And losers usually resist change.

First of all, for any transformation to occur (in this case, to create the most efficient, innovative, world-class City Hall to prepare for the City's massive challenges in the present and future), you must have a leader with the desire to transform the organization and the vision in which to do so. All transformation starts at the top.

In this case, let's just assume Antonio (or Schwarzenegger), or whomever WANTS to transform their organization just so they can point to something they did, come re-election/higher office time: Then, we can start to discuss some of the things that cause inefficency and beuracracy in hopes of helping you "transform the organization". (Get the City in shape for the battle ahead and become the world-class jewel of a City Hall that the international market can look to.)

Enemy #1: Fear. Fear is something that is hard to measure with statistics, so it goes unchecked. However, "management by fear" is the biggest source of inefficiency at any job or goverment agency. Fear robs the employee of it's "pride and joy". It causes people to pass the ball; say things like, "That's not my department" (when they know the answer) -- because they are too scared they will get in trouble, even if they DO the right thing. And again, a work environment of fear starts at the top of the organization. In this case, that would be the mayor of any given City. You can judge customer service/how the customer/constituent will be treated, by how the staff is treated, by the boss. (ZD can tell a lot about a Councilmember, by their staff, as well...beyond the diversionary smiles.)

It's up to management to train and educate workers to the process, help them all be able to think as you would, and give them the power to make those decisions and take those actions to handle the problem and get it done. (THAT'S the Deming take on "Empowerment.")

The car salesman who can finanlize the deal, without having to get apporval from another boss, will allow the deal to be closed sooner, allowing the salesman to move on to the next customer more quickly, and the boss/manager can use his time for something else, other than holding his employees hand, by refusing the salesman to approve his own deals, because he/she is a control freak -- who is his/her own worst enemy to efficiency and an environment that generates "pride and joy" in the workplace, and therefore, product and services.

You also have to strive to break down the barriers between departments that add to the inefficiency. For example in the auto industy. It doesn't do any good to design an automobile that the facotry line can't build. In radio, many formats bite the dust -- not because of low ratings, but because the sales department and programming department are on different pages. And that's because the goal of the sales department (sell as many commericals as possible) is in direct conflict with the goals of the programming department (the least amount of commercials as possible) since programming bonus incentives CONFLICT with the goals of the sales department.

NOW, apply that concept to all the different departments at City Hall...Each department with their own projected quotas and statistical hoops to jump through; and no wonder all these departments are working independently, instead of interdependantly. They are pitted against each other, from the start. (Tony, call ZD to help you with a new flow chart and we'll talk about the problems with quotas and commissions and all that.)

ZD's EMPOWERQUOTE: "You don't work for Councilmember Blank, or the Blank department...You work for The City of Los Angeles and Mayor Antonio Villaraigosa."

And when City workers know that the Mayor wants everyone to have a one-time re-training session (like Captain Musquiz did with his officers regarding the Brown Act), and they know the Mayor recognizes that THE PEOPLE are the Cities biggest asset -- not the property, or equiptment, or even the building itself -- but the people; and the City needs everyone to take on new individual leadership (empowerment) to please go ahead and do those little things (human "fudge factor" if you will) that allows the machine to move along, uninterrupted. The workers are your biggest asset because THEY are the ones in the front lines; doing the jobs, and see everyday where things are going right and where things are going wrong. Empower them to answer the question, fix the glitch, or close the deal.

That's how you get employees to stop being lazy and simply saying, "That's not my department." I know you won't even be able top fathom this concept. But everyone should be able to do everyone else's job at the cafeteria. The server, should be able to be a cashier (if someone gets sick), or become busser (if the tables are overflowed), or become hostess if the line is getting long. (I know, you're head is exploding.) The cashier should be able to answer the question the customer has, without having to "get a manager." (Then you have customers waiting in line because the cashier has to get the manager, only to press the button the cashier could just have easily pressed.

But management across America, not just City Hall, likes to keep employee feedback at bay. "We know what's right. We have paid consultants ealuating the situation and coming up with an expensive report of suggested recommendations." When the worker could add some input the report would never uncover.

For example, statistics show workplace injuries are way up. Top managment becomes aware of the situtation and gets involved..."How could this be? Tell these idiots to be more careful. Hire a saftey workplace consultant to give a seminar as to how to be more careful." Failing to realize the problem is the unsafe railing that isn't scrwed in tightly enough and you have a water leak in the roof that is making the factory floor slippery in the morning. But workers don't say anything, cause they don't know who to turn to, or don't want to seem like they are making problems. Because they are working in a fear based environment. (Deming says "fix the system" for the workers-- don't bark meaningless exhortations about safety when you have slippery floors and loose railings.)

Call 3-1-1 And DEMAND That Villaraigosa, Garcetti & Alarcon DO F*CKING SOMETHING To Save A Penny and Stop FUNNELING MONEY INTO LOSER BELLY UP PROJECTS

I've blogged about the water crisis; subprime; oil prices; wall street failures; econonic depression; LACER pension risk; and the exact, specific situation the city and state is currently trying to come to grips with. So now it is here before us, and instead of Zuma Dogg doing a bunch of crybaby "gotcha" activism like the rest of the so called "journalists and bloggers and activists" who do nothing but complain about EVERYTHING and offer NOTHING: HERE IS WHAT IS NEXT. THIS WILL BE THE DIRECTION THE CITY, STATE AND FEDERAL GOVERNMENT WILL BE TAKING WHEN IT COMES TO OPERATING THE GOVERNMENT.

I've said all there is really to say as far as calling attention to the big issues that will be affecting us (as listed above). The city cannot afford to meet it's payroll; the city's retirement fund lost nearly $7 billion in one year and will be forced to bail it out with general fund money; two major L.A. real estate moguls went belly up and bankrupt; and Richard Alarcon wants to continue to pour money into any and everything he can funnel money into; just as it's about to go bankrupt. THEN, we can buy the failed project to save our investment.

I think it's about time the People of Los Angeles show up to City Hall Council Chambers and tell Alarcon, Garcetti and his wacko City Council coffer-suckers to shut up and get out of the way and let some real U.S. based leadership philosophies guide the city. And we'll leave it at that, FOR NOW.

So it's going to be the mayor's job to bring "methods of quality and productivity" to city hall. And it will be up to the people of Los Angeles to put Richard Alarcon and Eric Garcetti in their place, because after attending a year's worth of consecutive council meetings, I can tell you THESE TWO ARE THE PROBLEM AT THE CITY COUNCIL LEVEL.

HELLO PEOPLE OF LOS ANGELES...YOU ARE LETTTING GARSHADY AND ALARcon GET AWAY WITH WAY TOO MUCH. THE CITY CAN NO LONGER AFFORD IT. You cannot sit back and wait for the district attorney to take back the city from these two. IT IS UP TO YOU! DO SOMETHING PEOPLE! THEY HAVE ALREADY PULLED THE RUG OUT FROM UNDER YOU AND WILL BE PLENTY A-O.K. WHEN THE NATIONAL GUARD HAS TO BE CALLED IN TO SORT OUT WHAT VILLARAIGOSA AND HIS CITY COUNCIL HAVE JUST DONE.

CALL 3-1-1, RIGHT NOW, 24 hours a day, 7 days a week.

Ask to be connected to Council President Eric Garcetti's office and leave a message that you DEMAND City Council to stop pouring money into their cronies projects in the way Councilmember Richard Alarcon continues to motion for and that they implement SOME FORM of quality management tactics. I showed up to every city council meeting this past year to warn city council on the record and to alert the masses. Now, it is YOUR turn, because I cannot make it to the meetings anymore. Please try to make a little extra effort to show up, JUST ONCE, to talk about this publicly this summer.

Open Letter To Barack Obama Regarding Villaraiogosa's AFFORDABLE HOUSING RACKETTERING SCHEME

Re: Concerns of RACKETEERING Over Villaraiogosa's Affordable Housing Number Count (Residential Hotels being counted as "affordable housing" units.)

Dear President Obama,

First of all, congratualtions on your recent election victory.

I am contacting you, hopefully, as the next mayor of Los Angeles, as my name is on the ballot in the March 3, 2009 general election where I am challenging Hillary Clinton's former campaign co-chair, Antonio Villaraiogsa for the position.

Do a Google search for "Zuma Dogg" and you can catch up on my legendary, iconic status in the City of Los Angeles as the City's best-known gadfly and Villar's biggest nemesis.

The reason I am contacting you, Mr. President, is because I am concerned the City of Los Angeles may be trying to bamboozle you, when it comes to the number of affordable housing units the mayor will be claiming.

As you know, the City of Los Angeles receives Federal dollars, based on the number of affordable housing units the city offers.

And as you know, the mayor is up for re-election. So he went on TV and started bragging about how many new affordable housing units the city has added to the market.

And, if anyone knows how suckers believe whatever soundbite you give them, people think the mayor is helping the homeless with all this new affordable housing.

But here is where RACKETEERING concerns come into the picture. Here is what the city did:

They sent notices to a bunch of smaller hotel owners (the type of hotels with no more than 45-50 units) claiming that these hotels were "residential" units, and if they disagreed, they can send the City $600, plus all the registration records over the past three years, and their request will be considered.

Well, the city says no to all of these hotel operators, but if they want to try again, they can send another $600 and see if the results change.

The least expensive of these types of hotel rooms cost about $1000, minimum. And a more likely rate is $1700 or more, a month. THAT IS NOT AFFORDABLE BY ANY STRETCH OF THE CORRUPT POLITICIANS MIND!

The total number of hotel rooms at this rate that was added to the "affordable housing" increase that Viagraosa bragged about is about 19,000 units.

So when Villaragiosa applies for the Federal money based on the number of affordable housing units in the city, you better throw some investigators and auditors to go over the whole accounting.

Because this is just one of many angles Villaraigosa will be using to try and take advantage of you since you're just a rookie, and Villar is a seasoned career politician, who has the most ingenious and decietful scam-artists coaching him on all the shady angles to pilfer the city, state and federal coffers.

And I urge you to please throw your support to "Zuma Dogg" by endorsing me over Villaraiogsa. All he did was campaign for Hillary. NOT because he didn't dig you from the start. But because he though Hillary was going to clobber you. So he threw you under the bus, then regretted the decision, like so many of his personal decisons over the course of his term. Let's end his term.

Mr. President, besides this affordable housing scam, I urge you to contact your boy, Eric Garcetti, L.A. City Councilmember who idolizes and worships you over the city's Rent Escrow Account Program (REAP). It is another possible Federal Racketeering charge that may be leveled against the City of Los Angeles.
