RICHARD ALARCON PROVIDES TESTIMONY IN SUPPORT OF DOWD/DOGG "DECORUM" FEDERAL LAWSUIT: You may know DOWD/DOGG (Matt Dowd & Zuma Dogg) won a 1st Amendment lawsuit vs City of Los Angeles regarding Venice Beach boardwalk. And we are currently awaiting an October jury trial TO AWARD THE DAMAGES AMOUNT (for DOWD/DOGG and nine other Venice Beach performers, you haven't heard as much about, but are also on the lawsuit.)

HOWEVER, most of you probably DO NOT KNOW that "DECORUM" (City Council's "Code of Conduct" rules for public comment speakers at city council meetings) is YET to be ruled on by the judge.

That will be a summary judgement coming up, sometime before the October jury trial, to award the damages amount, by a jury.

The DOWD/DOGG FEDERAL lawsuit, of which the judge will rule upon, centers around the interruptions, cut offs, loss of time, ejections and bans (including VERY WRONG 30 day bans, of which DOWD/DOGG have at least three, each).

The judge will have two decisions to make:

a) Are council's rule of decorum valid, to being with. ("Facial" challenge)

b) IF it is found to be OK to enforce, is council applying it properly. (As applied" challenge)

So for example, the judge could say, "Yeah, I read the "Code of Conduct/Decorum" rules, and they're ok. It gives speakers enough freedom of expression, doesn't violate the Constitution. However, "as applied," I find council in violation of FEDERAL LAW!" [I personally believe, at THIS POINT, after THIS WEEK (and the past month, in general) council WILL lose on the facial challenge. And I am more confident that there have been OUTRAGEOUS violations "as applied." And DOWD/DOGG have videos of them all.

AND YESTERDAY, after L.A. City Councilman Paul Koretz, said he, "was very tempted to go over there and clock him," (a public comment speaker), INDICTED L.A. CITY CLOWNCILMAN RICHARD ALARcon, had to pop up to defend KORETZ, but it only provided DOWD/DOGG with the legal argument to be introduced, in court. And ALARCON can be subpoenaed to explain himself.

What KOETZ said (on LIVE TV) constitutes an Assault. The Penal Code defines assault as an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another. Pen. Code §240. " 'Generally speaking, an assault is a demonstration of an unlawful intent by one person to inflict immediate injury on the person of another then present.' A civil action for assault is based upon an invasion of the right of a person to live without being put in fear of personal harm." Lowry v. Standard Oil Co. of California(1944) 63 Cal.App.2d 1, 6-7 (internal citation omitted.). "The tort of assault is complete when the anticipation of harm occurs."Kiseskey v. Carpenters' Trust for Southern California (1983) 144 Cal.App.3d 222, 232.

Whatever DOWD/DOGG (Matt Dowd & Zuma Dogg) have ever said at Council -- out of "emotion" even bordering on a threat of violence let alone the kinds of things you have actually said -- is protected "under the civil liberties of this country."

Los Angeles City Councilman Richard Alarcon has told city officials that he expects a county grand jury to hand down an indictment against him on Wednesday, seven months after prosecutors served search warrants on two of his wife’s homes in the San Fernando Valley.

Sweet, Adorable, Nutty and Too Naive For The Public's Own Safety, Councilwoman Janice Hahn said she received a handwritten note from Alarcon, 56, (though he looks like he's in his 60's) that discussed what he described as "the D.A.'s action."

"He communicated with each council member, asking us to keep an open mind, and that he was going to fight this and continue to work very hard for the City of Los Angeles," said Hahn. Councilman Ed Reyes confirmed that he received a similar letter. [Yeah, works hard for the City, not it's business owners or residents.]

Alarcon, who represents neighborhoods such as Pacoima and Sylmar [NO, he DOESN'T represent them, unless you mean a contractor who lives in those areas], is expected to appear at a Los Angeles County courthouse at some time after 2 p.m.

Alarcon, who was in his chair during the council’s regularly scheduled Wednesday meeting, declined to comment. [First time THAT HOT-HEAD, TEMPER-LOSER has ever declined to comment.] His spokeswoman, Becca Doten, said he would have a statement about his legal situation at 3 p.m. “He’s getting his work done,” she said. His lawyer, Fred Woocher, also declined to comment. [Getting work done? Like funneling money into the Children's Museum and finalizing as many shady contracts as possible?]

Prosecutors have been trying for much of the last year to determine whether Alarcon lied about his residency, which can be prosecuted as a felony. [It shouldn't have taken a year. Just say, "Richard, tell us the truth...," and you know whatever he says, the opposite is the truth in reality.] They served search warrants in January on two homes owned by Alarcon’s wife, Flora Montes de Oca -- one in Panorama City, which Alarcon claimed as his residence, and another in Sun Valley.

The latter house is outside Alarcon’s district and is in a neighborhood represented by Councilman Paul Krekorian.

Once stripped of his council seat, please refer to Mr. Con as "Senator" Alarcon, because he will remind you that a Senator title is a lifetime title. BREAKING NEWS: L.A. City Councilman Richard alarCON Under D.A. Investigation...Two of ALARcon's Homes Searched

D.A. searches two homes in investigation of L.A. councilman's district residency (I'm sure they didn't find any medical marijuana.)

The Los Angeles County district attorney has opened an investigation to determine whether Los Angeles City Councilman Richard Alarcon illegally claimed a Panorama City house as his residence, officials said today.

Investigators with the D.A.'s Public Integrity Division served a search warrant Tuesday at a house on Nordhoff Street where Alarcon is registered to vote. The house is owned by Alarcon’s wife, Flora Montes de Oca, and is in his 7th Council District.

Another warrant was served at a second house owned by the councilman’s wife in the nearby neighborhood of Sun Valley. That house is in the 2nd Council District represented by newly elected Councilman Paul Krekorian.

David Demerjian, head deputy of the integrity division, said his office had received a complaint that Alarcon was living in a residence outside of his district. A politician who registers to vote at a place that is not his residence can be charged with a felony, Demerjian said.

Alarcon, 56, did not immediately respond to a request for comment. He was attending a news conference in Mission Hills this morning. The warrants, which typically explain why investigators believe a search is justified, are under seal.

[Updated at 11:30 a.m.: Shortly after 11 a.m., Alarcon told The Times that he planned to “make it very clear” to investigators that he resides in the house in Panorama City.

He also said that he and his wife live in the 1950 tract house on Nordhoff while Montes de Oca’s son lives in the house on Sheldon Street in Sun Valley.

“We want to focus on cooperating with their questions and I’m confident that when we’ve provided the responses to their questions that it will be seen as a very simple misunderstanding,” he said.] BULLSHIT RICHARD! In the summer of 2007, The Times reported that after Alarcon was elected that spring, he asked then-2nd District Councilwoman Wendy Greuel to support an attempt to redraw boundaries so his wife’s Sun Valley home would be moved into his 7th Council District. Greuel refused.

County officials said Montes de Oca is also registered to vote at the Panorama City house.

Alarcon had told The Times that Montes de Oca -- then his fiancee -- had been interested in developing town homes on the Nordhoff property that he had claimed as his residence. At the time, the councilman had introduced a measure to reclassify the street, a move that would have spared Montes de Oca from having to forfeit 2,840 square feet of her lot to the city.

Days after The Times reported on the proposal, Alarcon withdrew the proposal.

Nice to see Ron Kaye pile on top of Zuma Dogg's comments on how CM Bernard Parks is the only responsible CM who knows what is going on with the budget. Here are my comments from yesterday's blog, that repeat what I have said for months now, "Parks was the ONLY ONE talking like a responsible parent trying to let the children know that we have a problem on our hands and have to address the problem.

Not only that, but Parks seems to me to be the guy who is literally explaining it to the other CMs because he is the only one who truly knows what's going on and it IS like the "A" student trying to help his friends with their homework.

Some people may try to minimize or scoff at Parks for being overly-prudent and always crying that the sky is falling; BUT I THINK AS OF SEPTEMBER 5, 2009; I don't care who the mayor is, or who the council president is, or who anyone is...

PARKS IS THE ONE WE BETTER LISTEN TO, TO SEE WHAT'S UP!"

But some people like to wait until other people say something before they believe Zuma Dogg, so here is what Ron Kaye said about Parks and the budget on his blog today.

"He's (CM Parks) the only Council member who actually knows anything about the budget or has consistently tried to reduce spending. He also was the target of an $8 million independent expenditure campaign by organized labor to defeat him in the recent County Supervisor race won by Mark Ridley-Thomas -- and has seen during his four decades as a policeman and politician how the unions have come to take control of City Hall. He has watched his colleagues knuckle under to labor and how business interests come with hat in hand begging for crumbs from the table of power just like ordinary citizens.

Councilman Bernard Parks warned Saturday that at the current rate of spending, LA will run out of cash by May and face potential bankruptcy unless drastic steps are taken now. That means laying off thousands of workers since 80 percent of the city budget goes for pay and benefits -- something that won't be easy politically or practically since city rules make job eliminations so complicated it could take six months or longer to lay anyone off.

LA is fast running out of cash, spending $1 million a day more than it has coming in, borrowing heavily to pay its bills, running a $500 million current deficit, facing a shortfall of more than $1 billion next year and twice that in three years when every dollar of payroll will require 50 cents more to cover the costs of pensions.

The problem, Parks said, is unions have a stranglehold on power at City Hall. They elect the politicians, get sweetheart contracts from them and demand fidelity to their interests.

BUT I REALLY, REALLY, REALLY DO NOT THINK THE PEOPLE UNDERSTAND WHAT IS IN PLAY HERE WHEN I SHOW UP TO CANDIDATE FORUMS AND YOU SPEND TWO HOURS READING QUESTIONS FROM PEOPLE IN THE AUDIENCE AND NOT ONE OF THEM IS ABOUT THE BUDGET.

DO NOT ASK QUESTIONS ABOUT OPEN PARK SPACE, OR BUS BENCH ADVERTISING, OR "Yes/No" ON THAT PROJECT OR HOW TO INVOLVE NEIGHBORHOOD COUNCIL MORE IN DECISIONS....

THE BUDGET IS THE ONLY THING, RIGHT NOW....

Last week, when City Council passed the new billboard ban, making many of them illegal, City Attorney Carmen Trutanich put a call into Building and Safety Manager Andrew Adelman to tell him to start writing citations for the illegal billboards. (WAY TO GO NUCH!) So Andrew tells the mayor that he is going to do this. And the mayor tells him that he is not going to do that.

Andrew says that he IS going to do it.

The mayor says, no you are not.

Andrew tells Villar to stick it up his ass and that he IS going to issue the citations since the mayor is nothing more than a powerless, Mickey Mouse mascot in this town, anymore.

Minutes later, The Mayor's Office releases news that (a mere) search warrant was issued. Insiders I spoke with some insiders on this matter and they feel Villaraiogsa was a little quick on the trigger to release the news. A LOT QUICK!

I heard Los Angeles City Councilmember Richard alarCON is kinda getting nervous (completely panicking) over all the bad press Los Angeles Dumb City Council is getting on local radio and a certain local blog. Even though ALARcon's re-election isn't for a few more years, since he just got re-elected (un-opposed), he sees which way things are headed and sounded like he is DAMN WORRIED about NOT being re-elected in a few years, ALREADY. (Can you imagine how bad councilmembers will be looked upon in the next two, three years? NO INCUMBENT WILL BE RE-ELECTED, ESPECIALLY HIM!)

I didn't get to hear the item yet at http://lacity.org/, but here's what I have to check and see:
During Friday's item on water conservation, did Janice Hahn appear to be agreeing with/siding with Rick Nightengale, one of the public comments speakers from Van Nuys?

The reason I ask is because Zuma Dogg's ZumaBUG that ZD had someone drop inside Richard Alarcon's City Hall office broadcast some interesting chit-chat that sounded like Richard Alarcon himself.

I was also informed Rosie Betanos was voted down by the board, should reflect on the minutes, but what no "MAY Minutes". Does Your King The Alarcon Staffer have the right to overturn the right of the board? GEPENC board said it loud and clear NO TO BETANOS on grevience due to her public views. This is a violation of the Brown Act no one was notified of a second vote for a second vote for Betanos @ a possible special meeting.

ASSembly Speaker Karen dumBass rescinds pay hikes, thank goodness: Assembly Speaker Karen dumBass today said she would rescind pay raises she granted to more than 120 Assembly aides in midst of the state's fiscal crisis.

The move came a day after the raises were exposed by news outlets and less than a month before the May 19 special election, at which Bass, other legislative leaders and Gov. Arnold Schwarzenegger will ask voters to extend tax increases to help ease the state budget deficit.

L.A. councilman pushes childish and clownish solution to serious water shortage

"I seriously think we should look at offering cactus to (utility) customers," Alarcón said. "I ate one last night, and they're delicious.

"I think the DWP (Department of Water and Power) should hand out these drought-resistant plants along with recipes on how to prepare them and it would send a powerful message and reduce water use."

He suggested, for example, that the city could hand out small cactus plants to children at street fairs or schools.

"I would like to see us have cactus gardens all over the city," Alarcón said. "We would seriously cut our water usage if we gave out a million of these."
Alarcón's suggestion came as city officials considered further restrictions on water use in response to the drought.

DWP General Manager H. David Nahai, the voice of reason among the wackiness, said the utility has a landscape rebate plan that helps residents transfer to more drought-resistant plants, but it does not require cactus to be planted.

I've blogged about the water crisis; subprime; oil prices; wall street failures; econonic depression; LACER pension risk; and the exact, specific situation the city and state is currently trying to come to grips with. So now it is here before us, and instead of Zuma Dogg doing a bunch of crybaby "gotcha" activism like the rest of the so called "journalists and bloggers and activists" who do nothing but complain about EVERYTHING and offer NOTHING: HERE IS WHAT IS NEXT. THIS WILL BE THE DIRECTION THE CITY, STATE AND FEDERAL GOVERNMENT WILL BE TAKING WHEN IT COMES TO OPERATING THE GOVERNMENT.

I've said all there is really to say as far as calling attention to the big issues that will be affecting us (as listed above). The city cannot afford to meet it's payroll; the city's retirement fund lost nearly $7 billion in one year and will be forced to bail it out with general fund money; two major L.A. real estate moguls went belly up and bankrupt; and Richard Alarcon wants to continue to pour money into any and everything he can funnel money into; just as it's about to go bankrupt. THEN, we can buy the failed project to save our investment.

I think it's about time the People of Los Angeles show up to City Hall Council Chambers and tell Alarcon, Garcetti and his wacko City Council coffer-suckers to shut up and get out of the way and let some real U.S. based leadership philosophies guide the city. And we'll leave it at that, FOR NOW.

So it's going to be the mayor's job to bring "methods of quality and productivity" to city hall. And it will be up to the people of Los Angeles to put Richard Alarcon and Eric Garcetti in their place, because after attending a year's worth of consecutive council meetings, I can tell you THESE TWO ARE THE PROBLEM AT THE CITY COUNCIL LEVEL.

HELLO PEOPLE OF LOS ANGELES...YOU ARE LETTTING GARSHADY AND ALARcon GET AWAY WITH WAY TOO MUCH. THE CITY CAN NO LONGER AFFORD IT. LA Live and Grand Avenue Project boasts of five star hotels, luxury condos and specialty boutique shops. The Valley is proud to announce the opening of Neimen-Marcus and plans for their own "Grand Avenue Project" style project. Pacoima has plans to upscale. The City plans on turning East L.A. into something that would make Leo Decaprio and all his Hollywood crowd envious of the luxuriousness.

ARE YOU F*CKING NUTZ?!?!?

Have you looked around? Have you turned on the news? Are you aware of this downturn economy? Construction costs are SOARING!!! It ain't coming back, because the City, State and Feds allowed this situation to play out.

We are talking about a City and State that is in crisis mode and I think all the people in the know are now aware that basic police, trash, fire and general services will no longer be able to be provided in the way that we are used to and expect.

The unemployment money is running out.

All of this social service money people like Richard Alarcon and Ed Reyes have fought so hard to hand out to any living organism standing on U.S. soil is for nill...because there soon will not be any money left to funnel over to all of the applicants who came to this country to apply for these money and services.

The schools are on the "Highway to Hell" and DO NOT expect anything but a downward spiral o achievement.

You can take all the kids in the world fishing one time; you cannot fish -- OR ENFORCE your way out of the army of gang members on the streets.

First of all, you still have not made the decision to crack down on local terrorists who have taken over the streets. Secondly, you do not have the resources or personnel, EVEN IF THE MAYOR OF LOS ANGELES ACTUALLY DECIDED TO REPRESENT THE CITIZENS OF LOS ANGELES (INSTEAD OF HIS CURRENT ALLEGIANCES).

Secondly, you do not have the jail space even if you did go out there and round up every criminal on the street. AND YOU WILL NOT HAVE ENOUGH JAIL SPACE IN THE FORESEEABLE FUTURE. (At least another generation.)

LESS people are able to afford their current housing situation and MORE people will be competing for sidewalk space with Zuma Dogg as more families become first time homeless.

BUT YOU ARE TALKING ABOUT THE LA RIVER PROJECT, GRAND AVENUE PROJECT, LA LIVE, NEIMEN-MARCUS, A HUGE LUXURY VALLEY PROJECT (to compete with Rodeo Drive, LMFAO) and all the crazy upscale sh*t like Wyvenwood happening all over Los Angeles.

WHAT YOU NEED TO DO, is start building the emergency shelters, low cost housing (500 sq ft units) and the "Flea Market Row" project -- NOT THE GRAND AVENUE (and all the wannabe) PROJECTS YOU BIG DUMMIES!

AND YOU ALREADY KNOW YOU DEPLETED THE TRUST FUND AND HAVE NO WAY OF PAYING THE CREDIT CARD BILL NEXT MONTH.

But just like a gambling or crack addiction...LOGIC DOESN'T MATTER...you got a monkey on your back, and you gotta keep feeding it, or it will kill you for not keeping the promises you made in your most desperate of hours during the election, I mean day.

So either the City of Los Angeles is nothing but a bunch of stupid idiots that can't see the most obvious of big pictures -- OR they are purposefully and criminally negligent.

The good news is that there is currently a Federal investigation (F.B.I.) into Los Angeles City Hall. And Zuma Dogg feels that the Federal government has bigger problems in this Country than Rocky Delgadildo's wife.

But Rocky is obviously a big problem for this region, so it'll be nice to have him locked up and out prevented from the opportunity of a higher office.

And ZD hears that Villaraigosa's legacy will be that of the Detroit mayor. (Taken away in handcuffs and pushed out of office.) But ZD feels Antonio won't be getting off the hook as lightly, since he's in a Federal boiling pot.)

AND, the FBI investigation into Rocky is merely the tip of the iceberg tool they need, to start looking into emails -- and I think there will be some un-expected (not to ZD) Special Elections to fill some CM seats.

The bad news is the damage has been done...the City and region is on the fast track to Tijuanaism; all the problems currently being discussed will be spiraling downward at a geometric rate of progression; and we have a City Hall of elected officials who are walking around as though they are the Royal Family of Dubai themselves on some MC Hammer shopping and construction spree complete with gold faucets, marble tubs and diamond encrusted toilets.

The good news is, when things get this bad, you can't contain the stink...and it made it all the way to Washington, and the Feds agree with Zuma Dogg that this is a matter of public safety and national security. Between Cooley and the F.B.I, ZD says City Hall is about to get a fumigation. (Or maybe the F.B.I. just felt like hassling Rocky's wife of all matters of concern in the United States of America.)

AND REMEMBER YOU INFERIOR-MINDED, EMOTIONALLY WEAK, SPOILED BRAT CITY COUNCILMEMBERS: Water is not an unlimited, infinite, synthetic resource that you can produce at will. AND YOU ALREADY DO NOT HAVE ENOUGH WATER FOR ALL OF YOUR "SMART GROWTH" ERIC GARCETTI, SO I THINK THAT MAKES YOU "DUMB" (or criminally negligent).
