Judge's ruling on L.A.'s unconstitutional medical marijuana ordinance just helped Matt Dowd & Zuma Dogg in Venice Lawsuit!

How Friday's (1/7/2011) Judge's ruling on L.A.'s unconstitutional medical marijuana ordinance just helped Matt Dowd & Zuma Dogg on their Venice Beach lawsuit against the City. (Aka: They delay paying us, again...AND IT GETS WORSE FOR THEM, AGAIN!!! THIS TIME...THEY LOSE IT ALL...AND HAVE NOWHERE TO RUN!)

How so? First read THIS, which explains how a judge may not help the city write an ordinance, due to separation of powers between judicial (The Judge) and legislative(The City) branches:

LA TIMES: Judge refuses to lift medical marijuana injunction - 1/7/11

The judge who declared that key parts of Los Angeles' medical marijuana ordinance are unconstitutional refused to stay his injunction Friday as the City Council works on an amended version, and he rebuffed the city's request for advice on how to rewrite the law.

"I don't want to legislate. I'm not the City Council," Los Angeles County Superior Court Judge Anthony J. Mohr said at a hearing. "I really think I'm going to decline that invitation."

Mohr said that responding to the city's request for guidance would violate the separation of powers between the judicial and legislative branches. [End of excerpt from L.A. Times.]

So Matt Dowd and Zuma Dogg sued the city over 1st Amendment, constitutional issues, including Venice Beach and City Hall (public comment). There are many facets regarding the Venice Beach portion, alone.

October 21, 2010, a Federal judge placed an injunction on some of the Venice Beach portion of the lawsuit (regarding their Venice Beach ordinance.) However, there are still other aspects of the lawsuit that have not been ruled on by the judge.

At this point though, since the injunction does hereby constitute a LEGAL VICTORY for DOWD/DOGG -- and requires the city to admit defeat -- and either settle the matter...or we take it to a jury for a (much bigger) damage amount.

THE CITY WANTS TO AVOID THIS MORE THAN ZUMA DOGG DOES! (BUT, Zuma Dogg will also be happy to settle for a reasonable amount.) So currently, we are in settlement talks with the city attorney's office.

BUT, THERE IS A GAME CHANGER, NOW...regarding the time frame Dowd/Dogg are willing to accept (JUST GOT MUCH SHORTER)...and the amount of money we are willing to accept to allow the city to carry on at Venice with a new ordinance (JUST GOT MUCH BIGGER).

AND THAT GAME CHANGER IS THIS COMMENT FROM THE JUDGE ON FRIDAY'S MEDICAL MARIJUANA RULING: "Mohr said that responding to the city's request for guidance would violate the separation of powers between the judicial and legislative branches."

WELP, unfortunately, the judge presiding over our Venice Beach ordinance lawsuit...HAS BEEN WORKING WITH THE CITY OF LOS ANGELES ON CREATING A NEW ORDINANCE. This has been in the form of twelve status conferences with the City of L.A. (of which Matt Dowd was in attendance), where the judge crafted the ordinance with the city.

So first of all, because you may be wondering, why did he place an injunction on an ordinance he was part of crafting?: There was a new ruling that came out in the 9th Circuit (see: Berger) that caused it to become illegal. HAD the city had already settled the matter with Hunt/Dowd, on a previous lawsuit...NONE OF THIS WOULD BE AN ISSUE. The more the city delays, the worse it gets for them. (Plus, the city kinda didn't do it the way the judge recommended, anyway.)

SO NOW...on Monday, Dowd/Dogg will be filing for a summary judgment for the remaining portion of the lawsuit that the judge has not ruled on yet, awaiting the city to settle with Dowd/Dogg to prevent this whole enchilada from unraveling.

AND IT WAS GONNA BE PRETTY BAD FOR THE CITY ON THE REMAINDER, ANYWAY...but here's why it will be a TOTAL LOSS IN COURT FOR THE CITY, NOW...

THERE IS NO WAY THE CITY CAN WIN (or saying, "no way Dowd/Dogg can LOSE") SINCE THE JUDGE WORKED WITH THE CITY ON THE ORDINANCE. IT WAS AN ILLEGAL PROCESS...SO VICTORY GOES TO DOWD/DOGG IN IT'S ENTIRETY

Please write the check on Monday. And remember, two "G's" in my name, cause I'm twice that of which you will ever be.

City of Los Angeles May Pass Ordinance REQUIRING Civilian City Employees To Pay More Into LACERS Pension Fund

FIRST, read this, ZD's massive analysis of the City of Los Angeles' massive budget crisis.

It has been said, regarding the $7 Billion LACERS pension loss, a required part of the solution, I REPEAT...a REQUIRED part of the solution...is to have city workers pay more into the pension fund. (Of course that is not something they will agree to on their own.)

So, I was just reviewing City legislation to see what can be done about this crisis, since I see no leaders, only followers, and discovered that an ordinance can be passed by council to REQUIRE civilian city employees to PAY MORE MONEY INTO THEIR LACERS pension and retirement fund.

So you heard it here first:

YOU WILL SEE CITY COUNCIL PASS THIS ORDINANCE. (And the timing is of an URGENT nature, so look for that between now and May.)

Now mock it, criticize it, scoff it, deny it, turn your back on it and denounce it, as you have been doing each and every step of the way. But you would tell Rainmain it was 300 toothpicks, not 296, you arrogant, pompous, always wrong, combative dummies.

SPECIAL EVENT FEE MADNESS TRUCKS ON!!!: AND HOW ABOUT ENOUGH MONEY OUT OF THE GENERAL FUND, at a time when you are talking about firings and cutting services and raising fees and meter rates and new taxes --

WHILE CONTINUING TO SHELL OUT HUNDREDS OF THOUSANDS OF DOLLARS ON THINGS LIKE "running" events, like on today's agenda. You cannot RUN away from the budget problem, nor solve it by spending another $20,000 on "running event" again today.

Today, on the Special Event Fee Waiver item, there were a couple more races on the agenda -- and this week, CON's "El Grito" Shadifest bilked another $50,000 out of the city's general fund, after $75,000 already came through the week before. So that's $125,000 for El Grito fest, that I happened to catch. This must be one hell of an event. And I hope it is free and open to the public and isn't having paid sponsorships, and a lot of profit schemes.

FOURTH OF JULY FIREWORK SPENDING CAP, PLEASE?: And with Fourth of July coming up, ZUMA DOGG IS HERE TO REQUEST ON BEHALF OF THE CITIZEN'S OF LOS ANGELES THAT A SPENDING CAP BE SET BY COUNCIL ON HOW MUCH MONEY IS GOING TO BE SPENT THIS YEAR ON 4th of July CELEBRATIONS? I don't know how much was spent last year, and on how many events...BUT IF WE ARE FIRING TEACHERS AND THERE WILL BE MORE KIDS PER ROOM...

Then you BETTER be spending MUCH LESS this year on 4th of July events than last year, and on less of them, and the crowds can combine a little, or people can watch on TV, or go somewhere else.

THIS IS NO TIME TO BE "BOO HOO HOO" CRYBABIES WHO CAN'T HAVE THEIR FIREWORKS PARADE SCALED BACK IN ANYWAY.

SOMETHING'S GOTTA GIVE AT SOME POINT PEOPLE...AND IF IT ISN'T JOBS AND SERVICES, THEN IT IS PARADES, JOGS, SPRINTS, RUNS, WALKS AND FIREWORKS. Not all of them, but the expense better be scaled back in a way reflective of a city that just lost $7 BILLION in risky Wall Street and Real Estate developments, when they should have been in "investment grade" investments, and if Zuma Dogg was blogging alerts about it (if Zuma Dogg knew LACERS was in trouble at Wall Street and in Downtown projects of the mayor's patronige-cronie-special interest-camapaign contributors...then how come NO ONE in the Villaragiosa administration, Villaragiosa himself or ANYONE on City Council did a THING to look into it and prevent it??? ("L" on each of your foreheads, especially YOU councilmembers who stood silent, you spineless cowards.)

SO TO SUM IT UP VILLARAGIOSA AND LOS ANGELES SHITTY COUNCIL:

No more money on jogs, walks, runs, sprints, warm-up, stretches, face-painting, donut sprinking, or cronie enhancing events out of the general fund for the reasons stated above you stupid, irresponsible, cowardly dummies:

AND...SET A CAP ON HOW MUCH THE CITY IS GOING TO SPEND ON FOURTH OF JULY FIREWORKS. And it better be much less than last year. How can it NOT be you squanderous nincompoops?

I'm not sure if you are all just dumb, or corrupt? I think in most cases it's both.

Either way, cut the bullcr*p, take your heads out of Villaraigosa's ass...and Villaragiosa, take your head out of your own ass...and Robin Kramer...start telling your boss how severe the situation is and how City Council is nothing but a bunch of powerless grandstanders that can't help themselves...

LACERS $7 BILLION BAILOUT (FRAUD?) IN VILLARAIGOSA'S CITY OF LOS ANGELES: AND START ADDRESSING THE LACERS ISSUE AND FIND OUT HOW THE PEOPLE WHO WERE, AND ARE, MANAGING THESE ACCOUNTS GOT THE ACCOUNTS? Were there campaign contributions to Villaraigosa. Were they risky investments, instead of "investment grade" (especially into Villar's pet real estate projects, including CRA money..and now M. Maddux had declared bankruptcy. How much LACERS money was poured into Muerello Maddux properties, along with CRA dollars? Did the money managers get AIG sized bonuses while they lost $7 Billion in one year? And why did the City go deaf, dumb and blind like Roger Daltrey in "Tommy" and allow this to happen? HAVEN'T YOU IDIOTS HEARD OF "STOP LOSS" LIMITS???

I THINK PEOPLE SHOULD GO TO PRISON OVER THIS!!!! ASK SOME QUESTIONS PEOPLE...Forget the ducks, elephants, squirrels, museums, art exhibits, solar panels, $1 surpulus ambulances and all the other stuff...

YOU SHOULD BE FILLING CITY COUNCIL CHAMBERS AND ASKING THE MAYOR IN PERSON AT EVERY PUBLIC PRESS EVENT (SHOUTING IT AS COMPLIANT WITH THE FIRST AMENDMENT) ASKING THE QUESTIONS I HAVE JUST PRESENTED!!!

Do you think I thought these questions up, myself? Or do you think some smart people on the inside who know what questions to aks, whispered in my ear what questions to aks?

But day in and day out, people on the other side of the rope sit back like willing accomplices, standing silent. (NOT very high expectations for Wendy Greuel as City Controller. Do you think she's suddenly going to completely change? She was just elected. She could be showing us what to expect out of her office. She doesn't have to worry about getting re-elected with the mayor's support...

SHE'S never been MORE FREE to finally use her position to become a leader.

So I guess I am most disappointed in Ms. Greuesome Greuel for her Academy Award-worthy performance of "Hellen Keller" at the LA City Council meetings.

NOW PULL THE PLUG ON NON-SENSE, PUT A CAP ON 4th or July spending, and get to the bottom of LACERS so it doesn't happen again (and so it isn't STILL happening) and SOMEONE STAND UP AND START MOVING YOUR MOUTH AND MAKE SOME CUTS, LOSERS.
ZUMA DOGG THREE YEAR ANNIVERSARY: April 4, 2006 was my first appearance at City Hall for public comment. Today I gave my 3 year Anniversary comment in Van Nuys. I'll post it soon.

At the end of it all, I have five bucks in my pocket; am hungry as hell; and desperate out of my mind. But the CM meeting went well, and Daily News included ZD in their story about Council with a full color picture. (See story below).

What a privlidge to have this blog on quality control at factories, health care and hospitals discover Los Angeles Candidate For Mayor, David Saltsburg ("Zuma Dogg") on a Google search for "Deming." Here is the impromptu interview that went down between the two Deming "14 point" fans, along with the intital blog post from this morning that ZD came across, as well, for a Google alert for "Zuma-Dogg". This interview is kind of like listening to a conversation between to Star Trek geeks, only Deming instead of Captain Kirk. And remember, in Japan, the American Deming's face is on a coin. He is like the George Washington of Japan. Trust me, the international global business community wants the U.S. to embrace Deming's 14 points. And Los Angeles is supposed to always be the innovative leaders on things ahead of the rest of the country. And L.A. is supposed to be an international town for business and tourism. Ask any leader you are doing business with internationally about Deming, and THEY will tell you. Here's the content:

A Deming Disciple as Candidate for L.A. Mayor?

L.A. Voters For Change: Los Angeles Mayoral Candidate David Saltsburg (Zuma Dogg) Answers Questions For Daily News

I won't pretend to understand Los Angeles politics (or much anything about L.A.). But, through an automated Google alert, I stumbled across a candidate (other than former Speaker Newt Gingrich) who is talking about Dr. W. Edwards Deming, the famed quality and management guru.

The candidate is David Saltsburg and he mentions Deming, talking about the L.A. school district:
I am certainly excited to be able to step up and show everyone the most innovative and empowering leadership at the scholastic level in the history of Los Angeles. My strategy is based on Dr. W. Edwards Deming 14 point management philosophy blueprint. If you don't know about Deming's 14 point plan, please do a search online, because my entire office will be operating under these 14 points (methods for management of quality and productivity). And until LAUSD firmly embraces these principals, the situation will never be allowed to improve, only continue to get worse.
Wow, if only more politicians talked like that.

Um.... on closer inspection, Mr. Saltsburg also goes by the name "Zuma Dogg." Yeah, that's not a typo. He's not a typical politician (which is a good thing, I'd say). Apparently, he sells products on Venice Beach and is pretty well known for fighting the L.A. City Council over their policies and ordinances, as shown in some pretty bizarre and entertaining YouTube videos, including this one (it sounds like he often has a good case against them):

This is the new standard bearer for Dr. Deming's philosophy in government? Interesting, eh? This is either the craziest thing or the most brilliant thing I've seen in a long time (quoting the classic movie This is Spinal Tap, "There's a fine line between stupid and clever.") I know what some of you might be thinking, but I'd vote for "clever."

So how do we reconcile Mr. Saltsburg, the candidate, with Zuma Dogg? He does clean himself up for appearances to support his candidacy and he sounds pretty intelligent. At 4:30 into the video below, he mentions Dr. Deming and his 14 points, the "Japanese economic miracle" and the need to cut waste inefficiency from government work.



I'm fascinated. Especially when you see what he writes about the use of the Deming philosophy, in regards to reports that the existing mayor claims to have fixed one million potholes, Saltsburg points out the harm done by quotas and targets:
Regarding the filling of one million potholes, the mayor's office has already admitted it's more like 85,000 potholes. Villaraigosa's problem is he goes around spouting off all these slogans and campaign promises that all sound good, but he may as well just get a job as Santa Claus, cause all he does is ready back a wish list. And the problem with the potholes that are being filled, is that they are not filling them properly, by removing the particles and topping off the seal properly, so they just turn into potholes again, way too quickly. I learned this from someone who read about my Deming 14 point plan. He was an engineer and told me he studied Deming and knew I would appreciate the feedback. Which I did.
So because of the quota, workers are under pressure to hit the number instead of doing the work properly the first time? This probably costs the city more in the long run, as he's right to point out.

Well, I'm fascinated. Anyone in SoCal have a perspective on the candidate? Maybe I can get him on the Podcast for an interview? His official campaign website and campaign video are online too. The election is March 3, 2009.

I emailed Saltsburg and got an email back (from Zuma Dogg) and we're going to talk on the phone later today. I'll see if I can turn it into a Podcast. Should be interesting, to say the least.

Some Good Reasons To Vote "NO" on Measure B (Solar Energy BONDoggle)

SUPPORT SOLAR POWER...VOTE NO ON PROPOSITION B.

There is a more efficient way to produce more solar power AND at a lower
cost using better technology - but if Prop B passes - the City will be
forced to spend hundreds of millions of dollars on outdated technology
that benefits no one but the people who paid to put this on the ballot.

This multi-billion dollar plan was placed on the ballot at the last
minute as the result of City Hall backroom dealings.

There were no public hearings and no engineering and operational input
from DWP. The Council did not consider the impact on Ratepayers, the
overall cost of this massive project, or the impact on the already burdened
infrastructure. Our rates were just raised 24%!

It is just another one of these tricky deals that says it’s about solar
energy and workforce development.

The LA Times wrote, “This rush to the ballot has the scent of swindle
about it."


The Council's own analyst explained that it would be better for the DWP to design a solar
plan with the public’s involvement and then have the Council vote on an ordinance. It’s
really that easy.

Trade union members, environmentalists, solar equipment manufacturers, DWP Ratepayers,
and citizens are disgusted with secret self-serving deals that favor special interests,
in this case the International Brotherhood of Electrical Workers.

· IBEW was the Mayor’s largest financial supporter.

· IBEW will be handed the entire “contract.” There is no competitive bidding.

· Other skilled trade unions can do the work more efficiently.

· The IBEW monopoly will cost Ratepayers hundreds of millions _extra_, which could
be better used to buy additional solar power!

Don’t be fooled by City Hall. Demand honesty and transparency.

EVEN MORE Bad Publicity For "Measure B" (Solar Energy Boondoggle) On March '09 Ballot (See Also: Eric Garcetti/Wendy Greuel)

Let's call this "Measure B" Solar Energy BOND, the Solar Energy BONDoggle!

Everyone. Please be aware that the mayor's lawyer has dragged Jack Humphreville, me (Ron Kaye) and others who signed the "No on Prop. B" ballot argument into to court today, challenging our statements.

This is being done even as the L.A. Times reveals today that a critical report exposing this solar energy plan as costly and "extremely risky" was being kept secret from City Council members and the public even as the measure was being rushed to the ballot.

The mayor's lawyer, Stephen Kaufman, representing Mitchell Schwarz of the League of Conservation Voters, is demanding opponents pay court costs and legal fees when we don't even have a lawyer. Stay tuned.

ZD's Reply: Oh my goodness. Congratulations, I guess, on their petty, vindictivness, once again.

Oh man, is this gonna garner MEASURE B (Solar Energy Bondoggle) EVEN MORE bad publicity on top of the LA Times article.

What a bunch of A-holes, if "The People" are stuck with the court costs. I can only hope, cause again...EVEN MORE bad publicity, making them look vindictive and retalitory.

NOW, some people will be scared to write a ballot argument. We need a "Special Order 40" type law, now, that will prevent them from being able to stick ballot argument writers with court fees. (LOL!)

IT APPEARS AS THOUGH "MEASURE B" (Solar Energy Bondoggle) IS THE SHADIEST THING ON THE BALLOT THAT ZD HAS SEEN. I'VE NEVER SEEN THIS MUCH BAD PR, FRESH OUT OF THE GATE, AS "MEASURE B" (Solar Energy Boondoggle) HAS GENERATED, SO QUICKLY. (See also: Eric Garcetti, Wendy Greuel.)
