NBC INVESTIGATION: DWP OVERCHARGES CUSTOMERS - Department To Issue Refunds (Class Action Lawsuit To Be Filed By ZUMA DOGG!)

BREAKING NEWS: THIS IS HUGE! DWP WILL OWE UNCOUNTED MILLIONS TO CUSTOMERS...and watch how shady the refund process will be. That's why I am working on a class action lawsuit as you read this. IT WILL TAKE A CLASS ACTION LAWSUIT TO HAVE DWP REFUND THIS "TRASH COLLECTION FEE" MONEY BACK TO CUSTOMERS. The problem: Many people who do NOT have the city remove their trash, have been getting charged for the "Trash Collection Fee," anyway. I CAN'T BELIEVE L.A. WOULD DO SOMETHING LIKE THAT?!?!

Click here to view the city's letter on this matter.

FROM KNBC 4 NEWS:

An NBCLA investigation has exposed how the LADWP has been wrongly charging perhaps thousands of its customers for a service they don't even get. The utility has apparently been doing this for more than a decade.

"How long have I been paying for this? I've lived here for 10 years. This could add up to a lot of money," says Venice resident Tamara Henry, who recently noticed suspicious charges on her DWP bill.

Henry noticed she's been charged up to $50 per bill for a "solid resources fee."

That fee is for city trash collection. But her Venice apartment gets its trash picked up by a private firm.

The city isn't supposed to charge you that fee if you don't get city trash pickup.

Our investigation found numerous buildings, including condos and apartments, where residents are getting charged for city trash pickup they don't get.

"I felt ripped off," says Yuson Shin, after she realized she's been getting charged for city trash pickup on her DWP bills for more than 10 years, even though her building has always had private collection service.

Last year, she began calling the DWP to get a refund.

"It took a dozen calls or more. They made me jump through hoops," says Shin.

She says DWP officials told her to call the LA Bureau of Sanitation. She says Bureau officials then told her they'd need proof from her apartment manager that her building gets private trash pickup.

According to the management company, Howard Management, it provided that proof, and the city lost the documents.

Months later, Shin's DWP bill finally shows that she's owed a $1,400 credit.

Some customers think the city is intentionally making it hard to get refunds because it wants to keep the money it's over-billed.

"Just think about that little charge, multiplied by hundreds of thousands of people, how that will increase their bottom line," says DWP customer Tamara Henry.

NBCLA tried to ask the DWP why it's billing customers for city trash pickup they're not getting.

DWP representatives refused to talk, and told us to call the LA Bureau of Sanitation.

A Bureau spokesperson said the organization wouldn't comment. So we tracked down the director of the Bureau of Sanitation, Enrique Zaldivar, and asked him about the erroneous charges.

"It's a database problem," said Zaldivar, explaining that a computer problem is causing DWP customers to get billed for city trash service they don't get.

We asked him, "Whose database has the problem, yours or DWP's?"

"It's hard to say, really, it's hard to say. It's hard to say which one," Zaldivar replied.

He also said the city has no idea how many customers are getting wrongly charged.

But apparently, the bureaucrats have known about this billing rip-off for more than a decade.

In 1998, a class action lawsuit was filed against the City of LA for this exact same problem: billing customers for city trash pickup they didn't get.

Records show the city settled the suit in 2000. The lawyer for the class action plaintiffs tells NBCLA the Bureau of Sanitation had to refund thousands of customers as a result of the settlement.

The Bureau of Sanitation declined to speak with us about the prior lawsuit.

Now, more than a decade later, DWP customers are still getting wrongly charged.

"This is money I could be using for something else," says Henry, whose been calling the DWP to try and get her refund.

"I'm getting the runaround," says Henry.

The Bureau of Sanitation has begun sending out 750,000 letters to DWP customers, telling them that if they think they've been wrongly billed for city trash pickup, to call 1-800-773-CITY or 1-213-473-5663.

A READER ALREADY WEIGHED IN TO ADD: ZD, I saw your post about the DWP report on Channel 4. Don't forget, a few (at least) years ago, DWP lost a lawsuit in the CA Supreme Court that charged them with wrongly charging taxes on the electricity they supplied. I've never been repaid that tax money they illegally charged me. I've been following all your blogging on the Pension crisis. Unbelievable amount of info. you've put out. I hope the right people are taking it all in.

Zuma Dogg Blogs About DWP Shadiness (Since Eric Garcetti Banned Me From Council Meeting Today, So I Have Time To Catch Up on DWP Courruption Concerns)

HELLO TO DWP BIG WIGS. GLAD YOU DIDN'T LIKE THIS POST. ALREADY HEARD YOU ARE NUTZ OVER IT WITHIN HALF HOUR OF THIS POSTING!
  1. DAVID NAHAI: Garcetti banned me from Council today, so I am catching up on some stuff. Today, it's DWP/Reasons you create fake water crisis.
  2. Is it illegal for DWP money to go into L.A. City general fund? This gives DWP/City incentive to keep rates high! Greuel needs to audit DWP$.
  3. DWP: Re-seeding mountains w/trees helps rainfall. Run off water is captured by pipes into drain reserve. They FIRED the guy with THAT idea!
  4. DWP SELF-IMPOSED WATER CRISIS: DWP owns HUGE Owens Valley water supply. They keep it on "hold" to keep rates higher. They create shortage.
  5. DWP: Notice the OCEAN to the left? Plenty of FREE water! Desalinization plants are cost effective and would drive down rates. DWP SAYS NO!
  6. DWP SHADINESS: I'm told there could be plenty of water available, making it cheap. But DWP benefits by higher rates so they thwart efforts.
  7. DWP also on Zuma Dogg's "insider tip" radar: 1st up; Nahai and sewer pipe contracts. A lot of expensive work being done with a certain guy!
  8. New post: L.A.'s Eric Garcetti Stealing Freedom of Speech: http://bit.ly/cppNW
  9. I want the people of L.A. to know, as the guy on the front lines, day in and day out, at the council meetings, GARCETTI IS OUT OF CONTROL!
  10. Sorry, Eric Garcetti. Nothing personal, your bullshit has been fun; but now you have crossed the line when you banned me. LADAILYBLOG.com.

DWP Wants To Scare You Into A New Rate Hike: Don't Buy It Until You Read About Their "Fraud, Waste and Abuse" Blueprint For Money Wasting

Don't Buy The Boo-hoo-hoo DWP Story Claiming They Need A Rate Hike: They could run the entire department on their waste and inefficiency alone
by Zuma Dogg

DWP is trying to scare you into a rate hike? The only thing scary is that the only concern of the powers that be, at DWP, is to hand out the contracts to their life-long buddies -- and how they get the kickback.

Here's Part One of this never-ending shady story of DWP concerning a lawsuit by eight former whistle-blower DWP employees. Click here.

BEFORE DWP ASKS FOR ANYMORE MONEY FOR LA RESIDENTS, HERE ARE A FEW THINGS MR. NAHAI SHOULD LOOK INTO. (Besides a Deming consultant.):

NOTE: But if you work for DWP, don't bring any of this stuff up, or you will be watched, followed, retaliated against, intimidated and fired.

a) Drive up cost of initial bid of the contract (that you hand to your friend) by adding an extra line item on the bid called, "miscellaneous" (for unspecified/undefined items). In one example, over 250 items came in under this "miscellaneous" line.

b) Overprice everything by 80%-100%. Mops, bleach, cleaners, towels, any item you can think of, charge DWP 80%-100% more. For example, when DWP workers ran out of a special industrial grade Kimberly-Clark paper towels that ("Gotham Supply") was charging $85 case for; an employee ran out to Grainger and bought a case for about $28.

c) After you mark everything up this much, send DWP old, outdated merchandise from some overstock warehouse. For example, Zuma Times has learned that DWP ordered cases of 8 oz bottles of Windex. And they got 8 oz bottles of Windex! Glass bottles. As in the old kind from the 70's. So old, at least, that the Windex was clear -- instead of blue -- and was packed in disintegrated boxes. (How much do you think "Gotham Supply" paid for the Windex?)

And remember, if you speak up, expect to be told to be quite, retaliated against and fired. [See Superior Court lawsuit for April 15, '08.]

d) Fire all veteran, experienced employees and replace them with new, inexperienced rookies to save money. Then don't train them -- just let them teach each other. Mistakes and bad habits are passed down the line.

The Times (Zuma Times) has learned that these new, untrained workers were/are doing everything wrong and most can't successfully complete a contract process. It's a very bureaucratic process, and if you need something for the job (like supplies), you have to order them six months in advance, which doesn't work, so everyone has to fudge the system. "The procurement system is broken", according to Nahai.

Splitting orders for example. Let's say you need 1000 gallons of bleach. But you are only allowed to order 500 gallons, per day. But you need 1000 gallons to get the job done. What do you do? Split the order! Twice the accounting and paperwork. Twice the bureaucracy.

e) If you are a big corporation, hire a company (like Onyx) that specializes in helping big corporations attain "minority ownership" status so that you can be handed more bids, with less heat.

These are just some of the ways DWP should start saving money first, before they try and scare you into a rate hike saying they need the money to prevent blackouts and whatever silly jibber-jabber they try and bamboozle you with.

f) Here's ONE way DWP may have saved some money: DON'T HAVE ANY SECURITY AT THE SWITCHING STATION. (The main controls where power grids are controlled.) You can also save money by not having any expensive security measures in place near the open area water supply. It's a lot cheaper to merely "say" you have security and just hope the Riddler doesn't show up to contamanate the water supply.

This kind of fraud, waste and abuse (misuse of funds by paying double for Windex from the '70s) may not be such an accident. It seems to many, as though it's all very carefully planned.

As I was researching this info, I realized it's the same stuff happening as with every other racket in town from LAUSD/Charter, non-profits, affordable housing, construction contracts, city and county services:

A few in charge hand out the contract to their cronies, then collect "campaign contributions" (shall we call them?) And the services can go to hell in a hand-basket...the only concern is that all of this shadiness and corruption is going end up coming out in public. But the newspapers have the politicians' backs, too.

And like one of ZD's early mentors told him: It looks like all of these things are happening independently, but when you follow the trail, they all orchestrated by the same symphony.

DWP claiming to need more money reminds me of a bank robbing ring asking the bank to place more money in the vault because they have been robbing it every night and they need more money to rob.

More to come at LAcityupdate.com.

BONUS: DWP'S David Nahai is a crybaby on top of it all. Here's his letter to LADWP/Oversight Committee Chair Soledad Garcia trying to talk her out of recommending City Council delay the DWP rate hike until the EIA survey is complete.

That will take six months, and slow down the flow of new money to grab, I mean use to prevent a loss of service. And in case the oversight committee doesn't decide to change their opinion on their own, Nahai lists a bunch of reasons why it doesn't count anyway. (Shady crybaby!) CLICK HERE FOR THE TEAR JERKER.

And here's Part One of this story.

NOTE: Alert to the 14,000 employees whose personal information walked out the door along with the laptop containing the database...watch for political mailers to magically start showing up in your mailbox. (Hope they are all properly labeled with proper disclosure.)

VIDEO: Dr. Daniel Wiseman on DWP Rate Increase Proposal (Arguments "For" and "Against")

From Dr. Daniel Wiseman of the Time Warner cable show "Your Neighborhood Council" and City TV 35 Public Comment.

More of Daniel Wiseman's DWP Videos (Click here)

DWP ON WEDNESDAY AGENDA: At L.A. City HALL, on WEDNESDAY, April 2, 2008 @ 10:00 a.m., the CITY COUNCIL will continue to hear and may approve/reject/continue CF 07-3247 (Power) and CF 07-3248 (Water) "base rate increases.

Here are copies of the 9 Amendments to City Council Files 07-3247 (DWP's Power Base Rate Increase proposal) and 07-3248 (DWP's Water Base Rate Increase proposal) in "pdf" format. Go to YouTube (MyNeighborhoodCouncil and dwisemanmd) to view videos Re: arguments describing (FOR & AGAINST) the DWP RATE INCREASES and these amendments,

They are part of the "whole" package of rate increases, proposed infrastructure improvements and proposed improved Water & Power Reliability Programs.

However, unless the City Council considers CF07-3248 (Water) first and separately from CF07-3247 (Power) of this very complex group of proposals they can't deal effectively with them.

Sometimes it seems as if the City Council would rather consider and "approve" the whole package and then move on to other matters. Approval of the DWP rate increase proposal(s) would be contrary to the specifically expressed wishes of 66 of the 75 NEIGHBORHOOD COUNCILS who are members of the NC-DWP Memorandum of Understanding OVERSIGHT COMMITTEE (OSC).

One argument posed by several City Council Members is that approval of the DWP base rate increases will assure the City of the desparately needed money which comes from the Power Transfer ($ 180+ million every year) and the Water Transfer ($ 30+ million, perhaps, every year). It would distract the NCs and the Public from considering the justification for the 10% Power Utility Tax (surcharge, $ 260+ million every year). These funds go to the City's General Fund where they may be used for a variety of non-water and non-power uses.

Right now, the City is $ 150+ million short of fully funding its current (FY2007-2008) Budget which goes to June 30, 2008. A $ 450+ million short-fall is predicted for next year (FY2008-2009) starting July 1, 2008. The $ 420+ million which comes from the DWP ($ 180 + $ 30 + $ 260 = $ 420) is desparately needed. However, it is the wrong money, coming from the wrong source. The DWP was created over 100 years ago to "deliver the best possible water and power to the people of Los Angeles at the lower possible cost." It WAS NOT created to provide funds to the City's General Fund for non-water and non-power uses.

Many people in the NEIGHBORHOOD COUNCILS have become much more knowledgable of the DWP and CITY BUDGET. They will be at City Hall, next Wednesday. It will probably be an important event for the entire city:

1. Do the NCs really have the ability to advise the City and have their advice heard, respected and/or followed?

2. Has the City Council taken all aspects of and all the alternatives to this important issue into consideration?

3. Will the Newspaper & Electronic Media be there and give full coverage to this "story?"

4. Will the best interests of the People of the City of Los Angeles be served.

BETTER STILL... Will you be there in City Hall?
Will you make your presence known to the City Council & to the DWP?

Will you make your own Public Comment on the issue? Write a story on the issure?

Daniel Wiseman

[And Zuma Dogg would like to remind Eric Garcetti, once again...it's Dr. Wiseman, not Mr. Wiseman -- even though you refuse to acknowledge this after all this time, you small man.)

Ad Hoc Meeting on L.A's (Alleged) NFL Stadium, DWP Ratepayer Legalease Committee Report & City Hall "Adjusts" Non-Union City Workers Pay & Pension

[Pictured: ZD tweets from top of the mountain of his undisclosed annex blogging studio.]

DAMN! City of Los Angeles caving in from the shadiness, when ZD takes a peek at the agendas (City Council and Committee Meetings from yesterday and today.) Here are links to PDF reports on TOP CITY ISSUES you have been reading about. Plus, links to any other L.A. City related story, ZD looked at. (Plus, RANTS!)

NOTE: L.A. City Council President Eric "Garshady" Garcetti wraps up his (final) term as President? New vote for next term during the Council meeting on Friday, July 1st. Word is Herb Wesson has the votes to become next Council president. (Eric is supposed to be stepping down to focus on his mayoral candidacy.) Zuma Dogg has been conspiratorial as to why he hasn't announced an exploratory committee to being fundraising, since the other city hall candidates (plus Austin Beutner) already have raised over $200,000, each. The conspiracy theory running through ZD's hopeful mind is he has to wait, cause his office has been questioned by the FBI over the Bonnie Brae affordable housing project in his district. And there IS a massive investigation into city hall, with phones being tapped and wires being worn for over two years, now. SO MAYBE HE DOESN'T WANT TO ANNOUNCE TILL HE'S SURE HE'S CLEARED (or not). OR, maybe he'll step down as council president, by design, and announce he's running for mayor. (Although he's got ZERO chance of winning.)

Nick Patsaouras STUNNING INDICTMENT of Villaraigosa's Measure B (DWP Solar Power Bamboozle)

HEY!

The following was sent to me by Nick Patsaouras, Candidate for City Controller and past president of the DWP. This is a stunning indictment of negative impacts of Measure B and I am asking that you publish this, prominently, so that voters have the information they need to make an informed vote. While I do not have a dog in this fight, I believe that what Los Angeles votes in March could, potentially, affect the entire country especially in this time of economic upheaval. Thank you for your help.

Solar Energy: The Right Way

For more than three years and more recently as President of the Department of Water and Power Board of Commissioners, I fought to end waste, inefficiency and contracting abuses in the city-owned utility and sought to create a Ratepayer Advocate to protect the public in the future.

Now we're being asked to give a blank check to the DWP and City Hall to spend billions of dollars on the nation's largest solar energy initiative ever -- a proposal that has no planning, no financial analysis, no engineering study.

Approval of Measure B on the March 3 ballot would be a costly mistake. It will cost ratepayers dearly, set back hopes for reducing our dependence on fossil fuels and provide the special interests and politicians with a license to steal.

I resigned from the DWP Commission in October right after this measure was introduced without even being brought to the DWP board, right after my efforts to bring transparency and accountability by creating the Ratepayer Advocate were brushed aside.

From my experience as an engineer, businessman and 30 years as a watchdog on government spending, I can tell you as a fact the DWP isn't up to the job managing a solar energy this big and this important.

As things stand, the DWP just doesn't have the managerial skill and experience to handle a $3.6 billion solar initiative that's supposed to deliver within five years more than 30 times as much solar energy as the DWP has been able to deliver in the last 12 years.

Despite its high wages and benefits, the DWP has a very hard time recruiting and keeping workers and maintaining existing water and power facilities. Its management and staff are already overburdened trying to fulflil the Department`s commitment to complete a multi-billion dollar investment to bring those facilities up to date.

Just 11 months ago, DWP management felt the best it could do was manage a program to add 20 megawatts of rooftop solar energy to government buildings. Now, it is being asked to own, install and maintain a 400 megawatt system on commercial and industrial buidlings as well plus oversee a public/private solar energy program twice as big.

If past performance is any measure of future success, DWP isn't up to the task of handling this much money. A wind farm in Utah was financed by Lehman Bros., the failed investment firm, and now DWP faces losing that project as part of its renewable energy portfolio or being hit with big cost increases.

Measure B is a blueprint for disaster and the public will get the bill.

Let's go back to the drawing board and come up with a renewable energy plan that makes fiscal sense and common sense, that protects ratepayers from catastrophic increases in their bills and delivers what we all went: A renewable energy program that we can afford, that is well planned and managed and makes Los Angeles the center of a thriving clean energy industry.

LA Residents Ask Los Angeles City Council to RESPECT THE CHARTER Regarding DWP Rate Increases

Subject: Respect the Charter
March 11, 2008

Respect the Charter

You would have thought that Antonio Villaraigosa, of all people, would respect the City Charter. But unfortunately, the Mayor, along with DWP, is pressuring the City Council Members to approve the Power Reliability pass thru and the multi year Rate Increase without the benefit of the Charter mandated IEA Survey.

According to the City Charter, this strategic Survey was due in October, in time for the Mayor, City Council, Controller, DWP and the public to reap the benefits of this $1 million survey by independent utility experts ahead of any proposed rate increases.

There are many questions that will be addressed by this Survey that cannot be answered by glib comments in a large public forum. Real analysis based on good information is a must, especially when we are dealing with such large amounts of money.

What is the impact on the Rate Payers of the Power Rate Increases? While described by DWP as ”fairly modest,” a “$1.60 a month,” rates are going up 20% over the two year period. Base rates are up over 15%. Pass thru rates are up over 40%. Modest?

Why have the June 5, 2007 projected Energy Cost Adjustment Factor revenues increased 80%, or $550 million, over the December 9, 2006 projections? Was this rate of increase anticipated when the City Council approved this “pass thru?”

Power System profits were $70 million over budget in the first quarter? What impact will this have on the need for the multi year Rate Increase and the Power Reliability pass thru??

What is the status of the many money saving recommendations of the Huron Consulting Group? Work force management? Project management? Shared Services? Customer Service? Information Technology? Others?

What is the impact of the Rate Restructuring Plan on single family residences? An additional 2 to 4% a year?

While DWP is clamoring for the immediate approval of the “desperately needed” Rate Increase, why did DWP recently agree to fund the Mayor’s $270 million Solar Initiative? And why is there talk of using some of DWP’s $600 million unrestricted cash to help balance the City’s budget?

How do DWP compensation levels compare to City workers and other regional utility workers, especially since DWP is considered the gold standard?

Respect the Charter. Do not rush hed into a major decision without good information and analysis. Respect the 1,400,000 electric and 640,000 water customers. And respect the 80% of the certified DWP MOU Neighborhood Councils which support the completion of the IEA Survey before action is taken.

BLOGGER'S COMMENT: At the time this was written the Metropolitan pass throughs were not included.

We were right. The Mayor plans to incorporate the DWP Rate Increase into his budget!!!!

Who says Nahai is truthful? The increase would be used for the City, not infrastructure. The bond ratings would not be affected up or down with/out the rate increases. Their indebtedness already on the books in unfunded pensions, health benefits, etc. would and do. The lack of increase is not the culprit. What kind of a legacy is Nahai leaving for the next General Manager and Community?

DWP is paying for all of Villaraigosas plans for green power and alternative resources. How much will be left for infrastructure?

A Letter To Constituents From L.A. Councilman Greig Smith on DWP Charter Reform

April 7, 2010

Dear Victims:

Today, I introduced a package of eight motions on Wednesday, April 7 to restructure and reform the Los Angeles Department of Water and Power and establish much-needed transparency and rate-payer advocacy.

This major reform includes changes to the City Charter and will restructure the DWP and hold it accountable to residents, businesses and Neighborhood Councils.

Residents and businesses in L.A. have had enough and they demand reform of the DWP. We need to bring comprehensive reform to restore citizens’ trust in this utility that they own.

The motions will:

- Improve customer service and make customer billing more transparent and easier to understand.

- Put a charter reform measure on the ballot to require the DWP’s budget, which was previously a closed book, to be voted on and adopted by the City Council.

- Put a charter reform measure on the ballot requiring Council approval for all rate increases.

- Put a charter reform measure on the ballot for wage parity, leveling the “paying field” between DWP positions, which pay much higher salaries, and identical positions in other City Departments.

- Discourage employee migration to DWP by preventing them from vesting in the DWP pension system for five years.

- Put a charter reform measure on the ballot to enable the City Council to remove any DWP Commissioner with a 2/3 majority vote.

- Put a charter reform measure on the ballot to enable the City Council to remove any DWP General Manager with a 2/3 majority vote.

- Reform the DWP Board of Commissioners, removing the Mayor’s sole appointment authority and dividing it among the Mayor, City Council and Neighborhood Councils. A certain number of Commissioners would also be required to have requisite expertise in specific industries.

Councilman Smith also introduced a motion in October, 2009 to create an Inspector General position that would serve as a completely independent watchdog over the DWP. He also introduced a motion that now requires an independent financial review for any rate increases.

To see all of the complete motions, visit http://tinyurl.com/DWPreform.

To see the editorial in the Daily News endorsing my motion to create an Inspector General position to serve as an independent watchdog over the DWP, visit http://tiny.cc/DWPeditorial.

Good Rick Orlov Coverage of LA City Council DWP Rate Hike Balk (Nahai Got DWP'd)

L.A. Zoo story: Fees to rise as much as 40% (DWP Story Included!)

Council defers action on controversial DWP rate increases

Faced with a massive budget crunch, the Los Angeles City Council moved quickly Tuesday to raise zoo admission prices - by as much as 40 percent for children - but balked at boosting water and power rates amid widespread public opposition.

The zoo hikes are expected to bring in $450,000 toward cutting a projected $20 million budget deficit this year, even as a city official called Tuesday for a review of dozens of other proposals designed to save money or raise revenue for the city.

But amid a campaign by neighborhood councils decrying proposed Department of Water and Power rate hikes, the council deferred any action until early next month.

Click here for details on the Zoo admission price increases.

But the DWP rates, originally sought to be imposed two months ago, proved more difficult and once again the council put off a decision.

After nearly four hours of public comment and discussion, the council wavered on the need for the increases - 6 percent over two years for water and 9 percent over three years for power - amid questions about whether the agency would use the money wisely. [Bullsh*t...Zuma Times hears it is going to be a 20% DWP rate increase over this time period -- PLUS, a Metro Water Department rate increase, on top of the 20% DWP increase.]

Several neighborhood council representatives also called for further review of the rate hikes and urged council members to look at other methods the DWP could use to raise revenue.

And Lydia Grant, education representative for the Sunland Tujunga Neighborhood Council, said the rate hikes will have a ripple effect on residents' ability to pay for a variety of things - including education for their children.

"How many politicians does it take to take education away frm our kids?" she asked the council.

City Councilman Bill Rosendahl urged support for a 15-member citizen oversight committee - one for each council member to appoint.

"I want to pick a person in my district who is a numbers freak, that sits on top of this like a pit bull," Rosendahl said.

"Summer is just around the corner," Nahai said. "(Critics) complaining about the rate increases will be complaining a lot louder when we have to go through another summer like we have the past few years."

[Nice threat tactic, Mr. Nahaiarosa. Are you saying this money would used to make the proper upgrades in time for the summer? I doubt it, when all the money is being wasted on purpose. (See Zuma Times story about DWP buying old, outdate supplies like cases of (glass) Windex bottles from the 70's, and worse!) Stop the Empire Line Item 36/185 stuff, then come talk to us, Mr. Nahaiarosa.]

Officials said another factor in the need for rate hikes is the annual transfer of DWP funds to the city's general fund.

A court hearing is scheduled for today on a lawsuit seeking to block transfer of DWP water funds to the city.

If successful, officials said, blocking the annual transfer could forestall the need for an immediate water-rate increase. It would not, however, affect the need for rate hikes to aid the DWP's power system.

DWP/City of L.A. Restricts Lawn Sprinkler Use To Monday & Thursday ONLY (Or Face UP TO $600 Fine)

From the Los Angeles Times

Q & A
How water conservation measures in L.A. will work

Drought prompts the city to limit automatic sprinkling, as well as adopt higher rates for exceeding a usage reduction of 15%. DWP officials discuss the new rules, which will take effect June 1.
By Alexandra Zavis

April 23, 2009

The Los Angeles City Council on Tuesday approved new water conservation measures that will restrict the use of lawn sprinkler systems to Mondays and Thursdays for all Department of Water and Power customers. We asked DWP officials how the new rules will work.

Does this mean I can only water my garden on Mondays and Thursdays?

No. Only automatic sprinkler systems are restricted. Hand watering using garden hoses fitted with shut-off nozzle devices is allowed any day but not between 9 a.m. and 4 p.m. The DWP has found that people who water their lawns by hand tend to be more careful about how much water they use. But when a sprinkler system is left unattended, the lawn is more likely to become over-saturated and the excess water runs off into the drainage system.

Why does everybody have to use their sprinkler systems on the same day?

This makes it easier to enforce.

How will the rules be enforced?

DWP has a water conservation team whose members drive through neighborhoods in Los Angeles checking for water waste. If your sprinkler is running on a Wednesday, they can cite you for violating the conservation measures. For a first citation, you will receive a warning. Subsequent citations are subject to a fine, which starts at $100 but can run up to $600. You can help by notifying investigators of potential violations. Call (800) 342-5397 or e-mail waterconservationteam@ladwp.com.

When do the rules go into effect?

June 1.

Is this the only change?

No, the DWP has announced a new rate structure to encourage conservation. It also goes into effect June 1.

How will the new water rates work?

Under the current system, single-family households are allocated a certain amount of water at the cheapest billing rate. This is known as your Tier 1 allotment and is determined by three measures: lot size, location and number of household members. A premium rate is charged for every additional gallon used in a billing cycle.

Under the new system, the Tier 1 allotment will be reduced by 15%. Say you currently get 1,000 gallons; your new Tier 1 allotment will be 850. When your water usage hits 851 gallons in a billing cycle, the premium rates kick in.

If you do not exceed your reduced allocation, the DWP says your bills will actually decrease. But if you have to pay Tier 2 rates, you will see your water bills increase dramatically.

So how do I find out my new Tier 1 allotment?

After May 1, you can go to the DWP website, enter your customer number and address, and you will be given your Tier 1 allotment.

How do I reduce my water consumption by 15%?

DWP anticipates that most people who cut their outdoor watering to two days a week will realize that 15% savings.

How long will the new rates be in effect?

Shortage-year rates are likely to be in effect for at least one year. During late winter and early spring 2010, the DWP will have a better idea of how this year's snowpack and rainfall levels will affect the water supply.

Are we likely to see more water restrictions?

If everybody abides by the new rules, the DWP does not anticipate any further restrictions. But if conservation goals are not met, the agency could ask the City Council to restrict sprinkler usage to one day a week and then to ban it altogether.

POWERFUL COMMENTARY on DWP Rate Increase Proposed by Villaraigosa (Aka: Collateral Damage)

Another 14% Metro Water Department (MWD) Increase On Top Of DWP Rate Increase...(What Is The City Thinking?)

Adding Injury to Insult: The Real Impact of the DWP Rate Increases

By Albert Abrams
Chairman

Government Action Committee
Tarzana Neighborhood Council

The timing of the proposed dramatic increases in DWP water and power rates couldn’t be worse.

Raising water and power rates right now, when so many Los Angelenos are financially hurting, will undoubtedly increase the rate of home foreclosures, loan defaults and business shut-downs, making the City economically vulnerable.

However, more injury is coming.

On top of the proposed increases in DWP water rates, the MWD, the main source of water for Los Angeles, has just announced that it will have to pass an additional 14% increase on to water consumers in Southern California. This on top of the DWP rate increases.

In addition, just one month after voters passed the controversial Prop. S phone tax, the City of L.A. is considering a plan to increase monthly trash fees again. According to officials, the additional funds are to pay for an ambitious plan to expand the LAPD. The City is proposing to raise the fee to $38 per month. Trash fees have increased from $11 to $26 over the past two years.

The cascading effect of all these dramatically higher tax and rate increases on Los Angeles households and businesses at once, when so many residents are at an economic tipping point, will backfire on the City. And once enacted, these new, additional taxes and fees will likely never be repealed or lowered.

In any business, before a major restructuring and increase of pricing is released on to consumers, a thorough, in depth financial analysis is done to ascertain what the true impact these higher prices will have on the marketplace.

In the case of DWP, this full review is required and its findings are to be made public. It’s called the City Charter Section 266a Five Year Survey. The problem is that DWP and some public officials, want the new higher rate increases to be immediately imposed on the public before the required survey is completed.

To many members of the DWP OSC, (the Los Angeles Neighborhood Councils/LADWP Memorandum of Understanding Oversight Committee), this resistance by the DWP to wait until the mandated full review is conducted, is an insult to the community that adds to the injury that the higher costs will have on individual water and power ratepayers.

The best policy to follow? DWP should first complete the lawful, required, Section 266a Five Year Survey.

If the numbers do indeed independently show a need for citywide rate increases for water and power, based on real figures, ease these new higher rates and prices into the L.A. local economy in carefully thought-out stages.

This type of phase-in will help our local economy take the shock of these new rates in a calmer, deliberate way, thus reducing the injury, and the insult, to the citizens of Los Angeles.

HUGE PAYOUT ALERT: City of LA & Department of Water and Power (DWP) Being Sued For Wrongful Termination Over No-Bid Contract Shadiness (THIS IS BIG!)

Ooooweee is April 15, 2008 gonna be a bad day for the City of Los Angeles and especially DWP. Not because that's tax deadline day, but because that's when the lawsuit against LA City and DWP is scheduled in LA Superior Court over wrongful termination of a DWP employee who blew the whistle on a shady no-bid contract deal, awarded to a company who supplied inferior and un-safe janitorial and custodial products -- and at a over-priced/higher prices.

Zuma Dogg KNBC-TV News-Style Investigative Report

Not only did workers complain, but so did local vendors who were shut out of business with the City and DWP. Complaints were made on numerous occasions before LA City Council.

Workers who complained were put under surveillance, harrassed and followed to their homes.

One of the issues, were these "pop-up tents" that a vendor was supplying DWP to protect workers from sun (provide shade) and shelter from rain. Well, the contract was pulled, and handed over to another vendor, who supplied what workers claimed were clearly inferior tents. City Council sent a deputy to inspect the tents and reported back that the pop-up tents, were indeed, clearly inferior. (Especially since they had tags saying, "Do not sell in State of California" since they were a fire safety hazard/not labeled as fire retardant.)

Due to this pressure, the contract was pulled from the new vendor (providing the shoddy tents); and handed back to the original vendor. (Whose idea it was to provide these tents to DWP in the first place and was even given one of those "Dog and Pony Show" awards by City Council.)

However, that was the last business they ever got from the City since, and have been shut out like all but one vendor, as some claim.

THEN, the DWP employee who did the whistle-blowing was fired, and the patronage/favored supply company was given new contracts.

Eventually, after Laura Chick's office had to look into it and contract with the patronage supplier was terminated (although was never investigated further), but, some say the company is still the "no-bid contractor of choice" through fake, dummy account names.

DWP was hoping for a summary judgment from the Superior Court Judge; however the eight people involved in this lawsuit against the City and DWP wanted the story to be told; and for the details to be put down on the record. (DWP's worst nightmare.)

So the judge refused a summary judgment, because she realized the First Amendment component. (Allowing the eight to get the story out and put it on record.)

April 15, 2008 is when it is scheduled at LA Superior Court.

Maybe we will read about this at some point in LA Times or Daily News.

DWP Rate Hilke Proposal To Got To Full City Council Agenda

To: Los Angeles Voters
Fr:
DWP Neighborhood Council Oversight Committee
Re: DWP Rate Hike
Dt: 3/18/08

Dear Colleagues,

First a very special thank you to the THIRTY people who came to support, participate in the Press Conference and make presentations before the Joint Committee. But, for you there may have been another result.

However, there was ONE NC Representative who presented a YES to a rate increase. There were seven news media people who responded to the Press Release. There were two TV channels: 7 and 34, two radio and two Spanish speaking and one English newspaper. If some of you saw, heard or read the Press Conference messages, they were basic to the IEA Resolution: no rate increase until the IEA is completed and shared with Mayor, Council, Controller and OSC and public.

In addition, no multi year increases--DWP did not advise OSC or NCs that multi year meant more than a 5 year rate agreement, but included increases on a quarterly and semi annual basis. The Energy Cost Adjustments and Surcharges are not only increasing, but rate payers are being charged quarterly. If the rate increase is accepted by the Council, DWP would like to start in May 08 with an increase and another one in July 08 (double increases) and another in 09, etc. There were other issues that reinforced the principal theme. The cruel impact of so many city increases of water, power pass throughs, City utility taxes, sanitation increases, garbage collection fees, telephone taxes, food costs, and gasoline increases are causing working families to suffer.

Councilmembers have an obligation to be protective of resident rate payers. But, they have to be reminded to be their advocates. Neighborhood Councils and Stakeholders need to talk directly to the Councilmember and say NO Rate Increases WITHOUT THE IEA SURVEY.

The RESULTS OF MONDAY'S COMMITTEE HEARING ARE THE FOLLOWING:

The Energy and Environment Committee did not offer a recommendation to Council.

The Budget and Finance Committee did not offer a recommendation to Council.

The DWP RATE ACTION WILL BE ADDRESSED BY COUNCIL ON MARCH 25TH.NEW CONSIDERATIONS BY THE COUNCILMEMBERS: HAVING DWP USE THE UNUSED $33 MM LITIGATED WATER CITY TRANSFER MONEY, LOOKING AT THE POWER PERCENTAGE AMOUNT, VOICING CONCERN FOR MULTI YEAR INCREASE

WHAT NCs CAN DO TO HELP IMPLEMENT THE IEA RESOLUTION AND STOP THE RATE
INCREASES:

Go to the Councilmembers and ask for their support in implementing the IEA Five Year Survey and No Rate Increase.

HELP THE CAUSE BY COMING TO COUNCIL ON MARCH 25TH. Each Council President has three free parking decals. Bring a carful of people. Prepare a brief two or three sentence presentation.

Positive results will happen if you come.

Soledad Garcia, DWP Neighborhood Council Oversight Committee

DWP hooked the utility inefficiencies of water and power infrastructure on the need for a rate increase. Black out scare tactics was put out: unless the city ungraded, there would be electric outages. The lack of maintenance these past 12 years is not new. DWP's priority was not infrastructure. The negligence cannot be placed on this year's lack of rate increase.

LA Times SLAMS Measure B, And Garcetti Looks Garshady Over This "Green" Plan

It's over for Measure B, the "green" energy solar measure on the March 3rd, 2009 ballot, that everyone was already against anyway, except for the shady politicians.

Analysis calls ambitious L.A. solar plan 'extremely risky'

An outside consultant says Measure B, which easily made the March 3 ballot, is more costly than portrayed by the city's Department of Water and Power.

By David Zahniser
December 19, 2008

When members of the Los Angeles City Council agreed last month to put an ambitious solar energy plan on the March 3 ballot, they talked effusively about their desire for cleaner air and "green" technology jobs -- the kind that could boost the economy during a recession.

What they didn't discuss was an analysis by a city-hired consulting firm that called the solar plan "extremely risky" and considerably more expensive than was being portrayed by the Department of Water and Power.

Measure B, which calls for unionized DWP workers to install solar panels on rooftops and parking lots across the city, sailed onto the ballot with a unanimous vote. But days earlier, the council's top policy advisor was so troubled by the proposal that, in an e-mail to Council President Eric Garcetti, he recommended that the council delay it until a future election.

After receiving the analysis from the consulting firm, Chief Legislative Analyst Gerry Miller warned Garcetti that the solar measure could result in "substantial increases" to the electricity bills of DWP customers.

Neither Miller nor Garcetti made those findings part of the public record. Since then, Miller's office has rebuffed requests from The Times for a copy of the consulting firm's analysis, saying the state's public records law allows city officials to withhold any document that would reveal the "deliberative process" between the council and its chief legislative analyst.

Miller said Thursday he is no longer worried about the cost, as long as the DWP can secure $1.5 billion in solar tax credits. But he said the agency still must deal with other findings from the consultant, which concluded that the utility "does not have the planning mechanisms and resources in place" to accomplish the solar plan.

Garcetti, for his part, said the consulting firm's findings were not made part of the record because they were among several opinions that he solicited informally on the ballot measure. Solar industry experts disagreed with the numbers produced by the consultant, he said.

"They said that this [ballot measure] was absolutely doable and that that [the consultant's analysis] was wrong."

Still, foes of Measure B said the findings confirm their worst suspicions about the measure -- and the process used to get it on the ballot.

Opponents have called Measure B a backdoor mechanism to make voters sign off on a huge package of DWP rate increases. And they accused Garcetti and Miller of concealing the findings of the private analysts, P.A. Consulting Group.

"That's the problem with City Hall," said former DWP Commission President Nick Patsaouras, who opposes Measure B and is running for city controller. "They think the average taxpayer is not smart enough to tell them the truth."

In a Nov. 4 e-mail obtained by The Times, Miller told Garcetti that he entered into a "quick contract with a very reputable firm" to study the solar plan at Garcetti's request. He offered to keep the analysis from other council members even as he complained that DWP officials had failed to do their own thorough analysis of the measure. "It concerns me greatly that the department did not come forward with this information themselves," Miller wrote. "It would have been as available to them as it was to me."

Miller later concluded: "Since this request came directly from you, I am not sharing this with [Councilwoman] Wendy [Greuel] or the other members until you clear it."

Garcetti said he later gave Miller permission to give the findings to other council members -- and would not have voted to place the measure on the ballot if he thought the findings were accurate.

Still, Councilman Bernard C. Parks, who heads the council's Budget and Finance Committee, said he never received the findings -- and wished that he had.

"If this is accurate information, or at least a point of view, the council should get the chance to ferret through this," Parks said.

The DWP has already agreed to impose increases of nearly 24% on electricity bills between 2006 and 2010. DWP officials contend the solar plan would lead to rate hikes of no more than 4% for the average household, and that those would occur no sooner than 2011.

But according to a one-page summary attached to Miller's e-mail, P.A. Consulting Group warned that ratepayers could face annual surcharges of up to 12% per year if Measure B passes.

The analysis also said that the solar plan would cost $3.6 billion, not the $1.5 billion suggested by DWP General Manager H. David Nahai.

"Bottom line is they do not believe that the department can deliver on this program at all, and that the costs associated with the program are way understated," Miller wrote in his e-mail to Garcetti.
CITY CONTROLLER ELECTION ALERT SIDEBAR: Wendy Greuel
wants to be City Controller? Not with a comment like this; "
Greuel,
who is also running for city controller, said she also looked at Miller's document
but concluded that the DWP had answered all the questions raised by it."

WAY TO GO "GREUESOM!" I LIKE THE OTHER CANDIDATE'S REPLY MUCH
