Downtown L.A. Power Struggle FLARES Over AEG Billboards at City Council Meeting
Once again, seems like there is confusion in L.A. City Council chambers as Bill Carter from the Nuch's City Attorney office informed council that the C.A.'s office does not feel a sign permit should be issued to AEG for "off site" signage at the Regal Movie Theaters. (This appears to be the most important issue in City history.)
Some of the confusion may even be about what the C.A.'s office is saying is allowed and isn't allowed to be installed.
The building permits, which were filed BEFORE the ban was put into effect are valid and Mr. Carter informed AEG and Council that they ARE allowed to build the sign frames, themselves.
However, you need a separate, "sign permit," to be able to install the actual sign. And it was made clear that AEG is even allowed to install "on site" signage, just not off site.
Mr. Carter said they could build the signs and put Michael Jackson "This Is It' Movie signs up and even wonder aloud why they haven't done that noting that NOT putting up the Jackson signs is, "their own business decision."
OFF SITE signage, which Carter feels is NOT allowed under the new ban, means AEG cannot advertise other products or services OFF THE AEG SITE. For example, can't advertise for an airline or automobile dealer -- OR OTHER RELATED AEG PROPERTIES, like hotels.
Tim Lewikie is making it clear, if they city don't follow through on the "deal" they thought they had, they'll lose $100 million dollars and sounds like he's gonna sue.
The big word in this issue is "vested." The city attorney's office doesn't feel the "vested" applies in this situation since there is a new ban in effect.
Koretz and Parks both mentioned that when they passes the sign ordinance (ban) it was not supposed to affect THESE AEG billboards that they all felt were vested.
However, "legislative intent is not the law," noted Carter back to Koretz.
"Out of an abundance of caution." That's what Bill Carter is calling," their initial measure of the issue is not about on site signs. AEG can, and could have done it for two weeks. They have built already. They want to put up OFF SITE signs, that's what this is about."
Zuma Dogg says you can expect Council to go back to hiring outside council a lot more often again. (That's from a council chamber fly on the wall.)
SOME NOTES:
* You need a separate permit for the installation of the sign.
* A building permit does not cover the sign, itself, you need a sign permit.
* You need a building permit, first. THEN, the sign permit.
The entire conversation is over the installation of the sign, not the building of the frame itself.
The sign must be "on site" advertising, NOT "on site" advertising.
If they wanted to put a sign up for the Jackson movie, it's ok, but not for American Airlines.
"If it's before Dec 22 08, then it's ok to put THAT sign up."
KNBC News Raw is broadcasting this hearing LIVE, and this is just about the biggest deal since Billy the Elephant and once again, I wish LAUSD and a few other issues would get this much media attention.
MY PREDICTION: Council WILL approve. That's what they do. They'll say they can't risk the city attorney's opinion being wrong (since it's not a slam dunk, but just their opinion): Carter is merely asking them to wait on a decision, but if it's not made today, it will be too late under the deadline.) And Council will say they don't want to risk being sued by AEG for $100s of millions. AND, they are going to vote in the legislative spirit of what they thought in the first place (that the new ban would affect these AEG off site billboards that they thought were "vested," even though Carter says that ain't good enough. AND, if the city passes these, others can sue by others who can claim "discrimination" (the city was found to be unconstitutional by picking and choosing who gets billboard permits and who doesn't) and the ban will be overturned. Council ain't going to go against big business like AEG because boo-hoo-hoo if they send a bad message to business.
LOOKS LIKE VILLARAIGOSA'S DAYS AS THE "BAD GUY" ARE OVER...Hello "LA City's Attorney's Office. The new punching bag for the "it's not our fault/you can't do this to us/boo hoo hoo" mentality inside LA City Hall.

"He's clearly given 'watch dogg' a whole new meaning." - Janice Hahn on Nuch. And added, "we treat people with respect in this city." Adding she hopes people don't go to jail if these permits are issued.
HERB WESSON is hammering Nuch, right now. Even though he said he likes what he is seeing in the city attorney's office, he questions Nuch running around to Tim Lewikie and Building and Safety executives in pre-emptive meetings like the ones where he threatened to throw people in jail WITHOUT city council asking him to do that, first.

Even Nuch's closest ally Dennis Zine is going to vote to allow this stuff through.
Council let their hired help (the city attorney's office) who is the boss and who is the client in THIS town! (AND, Jan Perry just announced what I mentioned above that she has a motion that will be looking for money to hire outside council, cause she doesn't feel comfortable having Nuch's office represent her (Perry) on this matter, any more due to his comments how he is against this and threatening to throw people (including her) in jail.
1:55PM OUTCOME: This was not a decision for city council to make. It is "Building and Saftey's" call as to whether to issue the permits, or not. Council was just making a recommendation on the matter.

What's interesting here, is how CM Jan Perry, Leiweke and the Times are orchestrating a media attack against Nuch. It's fun to watch. But don't believe everything you read.
And the Medical Marijuana community ain't too happy with Nuch, already. Maybe we can still call the City Attorney "Rocky" cause that's how his term is going to go. Nuch sure doesn't help himself. He sure does rub people the wrong way. But, gotta be careful not to throw the baby out with the bath water with Nuch. But MAN...the perceptions ain't looking too good out there. (KFI is now running a top of hour news piece on Nuch's perceived bullying.)

"I wouldn't say it was extortion. I would say it's a bully tactic. That's the way I would put it. He's trying to bully us. And he's done it on three different occasions," AEG President and Chief Executive Tim Leiweke told The Times' editorial board Wednesday.
His accusations escalate a growing public feud between the brash new city attorney and one of L.A.'s most influential corporations.
On the one side is the company that owns two of the city's most prominent entertainment venues, Staples Center and the L.A. Live entertainment complex. On the other is a city attorney who took office in July and has quickly developed a reputation for aggressive and sometimes unorthodox actions. Trutanich recently threatened to throw City Councilwoman Jan Perry in jail and file criminal charges against the city's top building-and-safety official if they violated his directives regarding AEG. [HOW CAN LA TIMES KEEP MAKING THIS CLAIM? JUST BECAUSE PERRY IS SAYING SO? CAN SHE EVEN PASS A DRUG TEST FOR CRACK? IT'S NOT LIKE HE SAID IT IN A MEETING, OR WITH WITNESSES. NUCH KNOWS SHE IS HIS CLIENT AS COUNCILMEMBER, AND HE KNOWS HE CANNOT ARREST HIS OWN CLIENT. Jan Perry is running for mayor and she is already campaigning against her perceived potential challenger. LOL!]
Trutanich said he's enforcing the law and looking out for the interests of Los Angeles taxpayers.
But Leiweke said he sees political motives. Leiweke is a major ally of Mayor Antonio Villaraigosa, and both backed Trutanich's opponent in the bitter race for city attorney earlier this year.
Since taking office, Trutanich has blocked sign permits for the company's new downtown movie theater and attempted to delay the city's plans to lease billboard space to AEG at the Convention Center.
Last April, Leiweke hosted a campaign fundraiser at Staples Center for Trutanich's opponent, Jack Weiss. "I can only guess . . . that part of this is that we were on the wrong side of that election," Leiweke said. [Good job, Tim! Marketing Warfare 101! That DOES plant the seed that this is political payback for backing the other guy. I'M NOT SAYING THAT'S WHAT IT IS, OR ISN'T. BUT I'M A MARKETING STRATEGY GUY, AND I THINK THAT HURTS NUCH, PERCEPTUALLY IN THIS WITH YOUR AVERAGE NON-INSIDER READER.]
Leiweke contends the feud began in earnest after Trutanich appeared before the City Council in July and announced there were "criminal aspects" to his investigation into how much the Jackson memorial cost the city. [Perhaps Nuch is trying to be diplomatic (believe it or not) and give Tim a chance to "cough it up" because maybe Nuch doesn't want to have to open up the "whole can of worms" that could have a lot of collateral damage/he doesn't really want to "go there." Otherwise, Nuch is bluffing...and I don't think he would completely bluff. So he PROBABLY has something, but it may be kinda messy -- or may require a lot to see all the way through...BUT...if you push him...the NUCH DOGG will unleash!]
Concerned that AEG was being accused of wrongdoing, Leiweke called and asked for a one-on-one meeting with Trutanich at the Starbucks at L.A. Live. Trutanich showed up with staff members, including two security officers, and it went downhill from there, Leiweke said.
"I said 'Nuch, I thought we were just going to have a quiet get-to-know-each-other,' " Leiweke said. "He kept his glasses on the whole time and just simply said, let me make sure you understand this straight. I am going back to the original City Charter and I am going to enforce it. And in this particular case, I believe you have done something wrong here, and you don't know what you don't know." [Again, maybe Nuch is trying to get him to cough up some cash, before we have to do it the hard (more disruptive) way?]
Trutanich requested that AEG reimburse the city for its costs, Leiweke said.
"And I said, what's your idea of settlement? And he said, $6 million. And I said, where did you get that number from? He said, that's the number," Leiweke said, recalling the meeting.
"He made it very clear, either you settle or I am going to go after you guys. I said, 'Fine. I'm sorry this didn't work out.' " [AGAIN, now we have to go off of what Tim says and the fact that LA Times is working in cahoots with people like Perry and AEG. IT'S A HELL OF A LOT OF FUN TO WATCH. But you kind of need the same grain of salt when you read the Times and you do when you read The Globe.]
According to City Hall's top financial analyst, the memorial cost the city an estimated $1.3 million for police overtime, installing portable toilets, redirecting traffic and providing other city services. Leiweke said he had offered to help defray a portion of the $1.3 million.
Dennis Zine argued the memorial cost the city millions more, including the salaries of all the police officers and other city employees deployed for the event, not just overtime. AEG and the Jackson estate arranged the memorial and "stand to make millions" in a movie gleaned from video of Jackson's rehearsals for his comeback tour, Zine said. [JEALOUS, DENNIS? Me, too. I know you're not that smart, but unfortunately, that's the way it works in America. You can make millions of rehearsal footage if people will buy tickets for it. Sounds like you want them to simply make a charitable donation. If Nuch has evidence that the law was broken with the event and the money paid for police and services, that's one thing. But if there was no law requiring permits for an event like this at the time (which I doubt there was, since they tried to pass a new one after this event), then it sounds like you are asking for nothing more than a charitable donation.]
Now, the conflict between AEG and Trutanich is centering on the upcoming Jackson documentary, "This Is It." The film will premiere Tuesday at the grand opening of AEG's new theater at L.A. Live, but Trutanich has blocked the company from erecting on the building wall signs advertising the movie. [I'm not sure it's such a good idea to strip away the Hollywood marketing and image, Nuch? I have to see the location, specifically by Olympic and the 110 where the signage would be. But this is Hollywood and a tourist attraction. Would you tear down the neon in Vegas?]
Two weeks ago, the city attorney warned the city's interim general manager of building and safety, Raymond Chan, that he could face criminal prosecution if he issued permits for six signs at the theater.
Perry said Trutanich also vowed to throw her in jail if she tried to intervene. [AND ZUMA DOGG DOES NOT BELIEVE HER AND FEELS SHE IS STRETCHING AND TAKING THINGS OUT OF CONTEXT.]
"You can't go around threatening people, trying to intimidate people and interfering with them when they're trying to do their job," Perry said, who on Friday had called for a council hearing on the controversy. [And when she say, "interfering" she means, continue the path of fraud, waste and abuse and same old business as usual. JAN PERRY...YOU ARE STARTING TO SICKEN ME AGAIN! I MIGHT SUPPORT WENDY OR ERIC FOR MAYOR OVER YOU!]
Trutanich last week denied making any threat, saying only that he has been aggressively upholding the strict ban on signage that the council approved in August. The ban prohibits new digital signs, supergraphics and billboards facing freeways.
"I'm serious about enforcing this ordinance," Trutanich said Friday.
AEG representatives said the city approved plans for the signs in 2006 and had already granted the structural and electrical permits for the six signs, with only the artwork permits still pending. The ban does not cover projects already approved and underway, including AEG's theater at L.A. Live. [BUT I BET THEY DIDN'T FILE THE PERMIT IN TIME. THEIR BAD.]
Leiweke said that if permits for the signs are not issued in a timely fashion, it could represent "hundreds of millions of dollars in damages" for the company. [HE'S SETTING UP THE LAWSUIT.]

Rich entities siphon taxpayer money while real communities struggle

EXCERPTS:...A thin, shimmering downtown tower, 54 stories high, wrapped in tints of blue, the nearly completed Ritz-Carlton Hotel & Residences and JW Marriott at L.A. Live. A short walk from Staples Center and the L.A. Convention Center, downtown’s newest asset is set to open in February 2010. From the days of Mayor Tom Bradley and through the years of his successors, Richard Riordan, James Hahn and Antonio Villaraigosa, L.A.’s political elite and city boosters have lobbied for what the Ritz-Carlton and its surrounding enclave embody: a long-sought luxury hotel for conventioneers, a centralized city, a populated downtown more like Manhattan.
L.A. Live is set to flourish, but the city is falling apart.
“I call it environmental racism,” says Daymond R. Johnson of South Los Angeles. “The streets leading into downtown have always been taken care of, but as you cross the 10 freeway and come south of downtown L.A., you begin to see the difference in the environment.”
“Environmental racism” might seem like hyperbole, but Johnson is a thoughtful neighborhood council member named by the California Democratic Party as Democrat of the Year for Assembly District 48. Johnson has represented the South Central Neighborhood Council on budget matters for the last six years. He works as a safety officer at a respected charter school.
He says that even such simple quality-of-life services as the synchronization of streetlights are handled differently in West L.A. than in his own neighborhood. Thanks to those double standards, he claims, “My neighborhood council area is one of the most deprived in the city of Los Angeles.”
Johnson, who lives in Councilmember Jan Perry’s district, notes that sectors of the city that have been starved, like South L.A., felt the budget pain long before any recession hit: “There was never a lot of attention to the area — so it would be an understatement to say that there have been cuts.”
Yet the city has, and is, aggressively pouring money elsewhere. Beginning with a deal signed on October 31, 1997, City Hall lavished millions of dollars in subsidies and tax credits on companies owned by Denver-based billionaire Philip Anschutz to fund the politicians’ downtown dream. City officials forced the poor out of 27 “blighted” acres of downtown around Figueroa Boulevard and replaced the aging neighborhood with lucrative ventures.
Although AEG’s Staples Center/Ritz-Carlton/L.A. Live endeavor will pay increased property taxes and sales taxes thanks to an expected growth in visitors to the area and its upscale hotels, L.A. taxpayers, who have poured so much of their public money into the deals, will not recoup the revenue from the lucrative hotel bed tax for 25 years. Thanks to agreements City Hall made with companies controlled by Anschutz, the 69-year-old recluse will keep pocketing these “bed” taxes — money that would normally flow to city coffers — until he is 95 years old and Villaraigosa and the City Council are long out of office.
A city-solicited study once boasted that taxpayers would reap $1.7 million annually from the bed taxes; in fact, Anschutz will see the first $62 million.
Moreover, instead of requiring the wealthy developer to secure private financing for the 27-acre project encompassing Staples, the Ritz-Carlton and L.A. Live, the city — meaning the Los Angeles public — provided an Anschutz company a $70 million, 25-year loan, which is being repaid on a yearly basis through Staples ticket sales.
Anschutz will not pay off that $70 million loan provided by L.A. taxpayers until 2025, yet public documents filed with the Los Angeles County Recorder’s office reveal that an Anschutz company has already sold off three significant parcels within the project area.
AEG took the revenue from the resale of the three parcels, a transaction allowed by the redevelopment agency, and then the city shifted the planned projects on that land over to new owners. Yet at least one of those key parcels contained lots seized by the Community Redevelopment Agency from a private owner, using the eminent domain statute, purportedly to fight “blight.”
The eminent domain takings in the area of what is now Staples and L.A. Live in the 1990s left many private landowners deeply embittered over being forced off their property at “market/fair value.” City Hall’s recent decision to let AEG sell seized lands means “they ‘flipped’ the property,” declares Marko Mlikotin, president of the California Alliance to Protect Private Property Rights. He calls the resale by private developers of lands taken via eminent domain “egregious.”
“The CRA was using public dollars to seize private properties. Shouldn’t that property revert to the original owner?” he asks.
It is almost impossible to tabulate how much money Anschutz made off the resale. Eminent domain was used in some form to take 107 of 152 lots around Figueroa, which were then consolidated into a huge property.
“Taxpayers are subsidizing these projects, but then developers and brokers are making huge profits.”Many political insiders see AEG, its president and CEO Tim Leiweke, and Anschutz as comprising a shadow government that continually persuades City Hall’s leaders to funnel public money to downtown, at the expense of South Los Angeles, the Eastside, the Valley and several other areas.
In fact, although the Los Angeles public is not aware of them, huge, additional subsidies are about to flow to the L.A. Live/Staples area. With a push from Villaraigosa and Perry, $50 million is being taken from the state Housing and Emergency Shelter Trust Fund of 2006, bonds approved by California voters to finance housing for battered women and the poor — or so voters thought. But in Los Angeles City Hall, the pols sought $50 million from the bond, a large chunk of which they plan to spend on sidewalk and street amenities to dress up Figueroa Boulevard downtown — which feeds directly into AEG’s publicly subsidized lands. [Remember ZD's, "Prop 1C money for Emergency Shelter For Battered Women, Children, Veterans and Disabled being used for the Grand Ave Project, commercial, cement park!?!?" Looks like since Grand Ave Project is on "hold" (LOL!) the money is being used for another commercial function.]
Mlikotin believes that “sound redevelopment projects don’t require developers to feed at the public trough or require eminent domain to create profitable business ventures. When public agencies continue to offer subsidies, why would any developer want to pay full market price, when they know that the local CRAs will provide taxpayer funding?”
SIDE BAR EXCERPT: "It generally does not concentrate huge profits, or tremendous political power, in the hands of one developer, like Anschutz — or the New York–based Related Companies, the chosen megadevelopers for the currently stalled luxury Grand Avenue hotel and shopping project."

Related Reading by Zuma Dogg...his greatest work ever, in his opinion, including uncovering pension money was invested in Grand Ave Project (CRA) and that it would never get off the ground, which it hasn't but I was told I was conspiratorial and crazy and that it WOULD get off the ground. Downtown Los Angeles Presents: Eli' Broad, Related Co., CRA, City Council and County's GRAND AVENUE PROJECT (Planning Details and Project Review)
You may have heard of the nearly $2 Billion Downtown CRA mixed use project called, LA LIVE. (A Ritz Carlton Condo/Hotel, Marriott Hotel, PF Changs, Movie Theaters, Specialty Retail and open space. [If you are a rich billionaire visiting from Asia, you will love investing in this area! If you are a business or organization planning a convention near the convention center, well you better try Vegas, this will price the city right out of the ballpark!]Plus a few other minor issues I am concerned about: Like the fact that there is no wat the City can be serious about thinking they can build another Universal City Walk Type project near Staples Center. They might be able to get some of it approved and built, but this is "pie-in-the-sky" fantasy land talk.
So just when you think there isn't enough demand for more five start hotels, luxury condos (instead of a range of affordable, middle and upper level residential housing for workers in the area), you forgot to factor in the fact that there is another OVER $2 billion five star hotel, luxury condo, specialy retail, restaurant and open space project to compete with the minimal demand. It's called...drumroll please...because it really deserves a prodigious, magestic, regal, fantastic, tribute of an introduction...

Except this one isn't free. So, I'll just by the bootleg DVD off the downtown streets the day after THIS event.

- No internet sales will be available for the special advance screenings; later shows will be available for purchase online
- Special Advanced Screenings on October 27th mark the Grand Opening of Regal Cinemas Stadium 14 at L.A. LIVE
Line Rules
- No line-ups before Thursday, September 24th at 5:00 PM (Nokia Plaza L.A. LIVE)
- No tents
- No alcohol
- No cooking on-site
- Limit one chair per person
- Smoking in designated areas only
- Only eight medical marijuana collectives within walking distance
- No boom boxes – music will be provided
- Must remain in line to hold your spot; tickets go on sale on September 27th at 12:01 AM
- Line monitors will issue passes for restrooms, food breaks and to those attending events at STAPLES Center, Nokia Theatre L.A. LIVE, Club Nokia or Conga Room
Parking
Parking for overnight line-ups is available in Lot 4 (963 Francisco Street, northwest side of Olympic & Francisco) starting at 4:30 PM on Thursday, September 24th. Overnight parking for those waiting in line is FREE. Parking for line-ups will be closed once the maximum of 1,500 wristbands have been distributed.

Zuma Dogg Feels it is the PayPal account that was set up for AEG/Jackson Memorial that COULD BE Part of L.A. City Attorney's CRIMINAL Investigation
That could be construed as fraud or maybe embezzlement? Maybe nothing...but definitely shady when that money was not actually going into an official city account or fund. Imagine if you find out a PayPal account claiming to be "City of Los Angeles" was just Joe Schmoe's personal Paypal account? Hmmm.
